The BRIDGE Watch Project is pleased to announce the winning paper of the Jean Monnet BRIDGE Watch Scientific Merit Award from the IX Jean Monnet Network – BRIDGE Workshop, held on April 9th, 2025, at Universidad del Salvador, Buenos Aires, Argentina, with the theme “Human Rights, Dignity and Equality: A Dialogue between Latin America and Europe”.
Award-winning author:
– José Humberto Sahián
Doctor of Law from the Universidad Complutense de Madrid. Postdoctoral studies in Law at the Universidad de Zaragoza and the Universidad Nacional de Tucumán. Professor of “Competition Law” and “Consumer Law” at the Universidad Nacional de Tucumán. Corresponding Member of the National Academy of Law of Córdoba. Honorable Mention from the National Academy of Law of Buenos Aires for the book “Dimensión Constitucional de la Tutela a los consumidores”.
Title of the paper:
“Convencionalizacion del derecho privado y privatizacion del derecho de los derechos humanos. Un desafío futuro para la protección cabal de los derechos humanos”
The awarded study explores the growing “constitutionalization” of private law, using consumer rights as a paradigmatic example of today’s consumer society. Building on this, the study proposes an inverse view of the connection between international human rights law and private law. The article argues that a symbiotic feedback loop is taking place, and human rights law must begin to be “privatized,” emphasizing the idea of responsibility and, eventually, passive legitimization of companies.
