O presente artigo procura explicar os instrumentos que a Uni\u00e3o Europeia disp\u00f5e para assegurar que os valores fundamentais europeus, incluindo a ideia de Estado de Direito, s\u00e3o respeitados pelos Estados-Membros. Resumo<\/h4>

Territorial struggles in Colombia have been at the very core of the armed conflict, which has made this the country with the greatest displacement in the world. As a result of its multiple effects, as a product of the Peace Agreements, the national government of that time created the Victims and Land Restitution Law (1448 of 2011). However, its temporal delimitation excludes a large number of victims who lost their properties before the 1st. January 1991, during the 1980s when the conflict in the country deepened. In this sense, this article seeks to investigate the scope and challenges of the implementation of this Law in the Banana Zone, a municipality widely affected by dynamics of exploitation of natural resources, drug trafficking and paramilitarism, which, moreover, has a population majority Afro-Colombian, an aspect that requires the application of a differential approach.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Nos \u00faltimos anos, o Tribunal Constitucional da Rom\u00eania tentou criar um muro interno por n\u00e3o aplicar o primado do direito da Uni\u00e3o Europeia, respetivamente os ac\u00f3rd\u00e3os do Tribunal de Justi\u00e7a da Uni\u00e3o Europeia relativos ao Estado de direito, no que diz respeito \u00e0 pr\u00f3pria Constitui\u00e7\u00e3o, desenvolvendo um controle ultra vires<\/em> ultra vires e um controle de identidade de uma forma original. Embora a press\u00e3o para alterar essa abordagem seja omnipresente, os motivos da Decis\u00e3o n.\u00ba 390\/2021 n\u00e3o foram revistos at\u00e9 hoje pela jurisprud\u00eancia subsequente do Tribunal Constitucional da Rom\u00eania, mas, pelo contr\u00e1rio, em dois comunicados da imprensa, foi lan\u00e7ada exclusivamente a ideia de rever a Constitui\u00e7\u00e3o para aceitar os efeitos da jurisprud\u00eancia pertinente do Tribunal de Justi\u00e7a da Uni\u00e3o Europeia nesta mat\u00e9ria. \nNo entanto, uma s\u00e9rie de decis\u00f5es de alguma forma soberanistas, incluindo tamb\u00e9m aqui a interpreta\u00e7\u00e3o pr\u00f3pria e extensiva de um parecer da Comiss\u00e3o de Veneza, parece estar em vias de ser abandonada, sendo um exemplo a este respeito a recente Decis\u00e3o n. 283\/2023, pela qual o Tribunal Constitucional da Rom\u00eania reafirmou a necessidade de impor um limiar no caso do crime de abuso de poder.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

This paper examines the function of the Permanente Review Tribunal \u201cTPR\u201d as a possible actor for the consolidation of democratic governance and the democratic state. In this sense, the question that will be the axis of analysis of this work is posed in the following terms: Does the TPR have any function aimed at guaranteeing democratic governance and the democratic state in the States that make up this integration process? As can be seen, this study is based on a systemic vision where the Supreme Court of Mercosur could be in a feedback relationship with the internal legal systems of the States parties that comprise it. The Work is organized as follows: (i) firstly, some guidelines are made on the central notions used in this work (democratic governance, rule of law and democratic state) (ii) secondly, we will make a general exposition on the essential elements that make up the so-called broad democratic dimension and the Ushuaia Protocol (PU) on democratic commitment in MERCOSUR, (iii) Next we will address the question of the role of jurisdiction in the integration processes in general and in MERCOSUR , in particular, focusing attention on the work carried out by the TPR, (iv) finally, an Award issued by the TPR will be brought to consideration that may leave some clues to answer the question posed. Resumo<\/h4>

A promulga\u00e7\u00e3o da Constitui\u00e7\u00e3o Federal de 1988 provocou significativa expans\u00e3o das compet\u00eancias do Poder Judici\u00e1rio, bem como um consider\u00e1vel crescimento da influ\u00eancia de seu \u00f3rg\u00e3o de c\u00fapula, o Supremo Tribunal Federal (STF), na vida cotidiana. A mudan\u00e7a se concretizou por significativas reformas no sistema ent\u00e3o vigente, bem como pela evolu\u00e7\u00e3o natural do contexto pol\u00edtico-social do pa\u00eds. Tal contexto, diretamente influenciado pelo \u00e2nimo da redemocratiza\u00e7\u00e3o do Pa\u00eds no momento da constituinte, levou a uma aproxima\u00e7\u00e3o gradual do Tribunal com as demandas mais sens\u00edveis da sociedade. No momento, uma das principais ferramentas de conex\u00e3o entre a opini\u00e3o p\u00fablica e a Corte tem sido o peculiar processo decis\u00f3rio desta, que, se por um lado parece favorecer a transpar\u00eancia e a participa\u00e7\u00e3o da popula\u00e7\u00e3o, por outro provoca certa inquieta\u00e7\u00e3o em parcela dos estudiosos do assunto, nomeadamente no que diz respeito ao elevado individualismo dos Ministros integrantes do Tribunal e \u00e0 \u201cextrema\u201d publicidade que n\u00e3o raramente predominam no processo. Diante desse contexto, o objetivo do presente trabalho \u00e9 evidenciar em que medida essas quest\u00f5es afetam o atual processo decis\u00f3rio do Supremo, bem como sugerir alternativas para a supera\u00e7\u00e3o de outras consequ\u00eancias negativas decorrentes do atual modelo brasileiro. A pesquisa adota uma an\u00e1lise qualitativa aprofundada da doutrina pertinente sobre os temas, com um pequeno vislumbre comparativo de outras experi\u00eancias constitucionais. Resumo<\/h4>

O presente artigo de natureza descritiva possui como objetivo analisar os efeitos da restri\u00e7\u00e3o do direito ao voto para as pessoas privadas de liberdade, j\u00e1 exclu\u00eddas socialmente e estigmatizadas por sua condi\u00e7\u00e3o, na nega\u00e7\u00e3o do exerc\u00edcio da cidadania do indiv\u00edduo, possuindo como consequ\u00eancia o aumento da criminalidade. No primeiro cap\u00edtulo, por meio da metodologia hipot\u00e9tica-dedutiva, com base em uma revis\u00e3o bibliogr\u00e1fica sistem\u00e1tica de fontes prim\u00e1rias e secund\u00e1ria, buscou-se reunir e analisar a literatura e a legisla\u00e7\u00e3o existente sobre o tema dos direitos pol\u00edticos dos presos no contexto brasileiro e suas hip\u00f3teses de restri\u00e7\u00e3o. No t\u00f3pico seguinte, al\u00e9m da metodologia supracitada, buscou-se apresentar dados versando sobre o cen\u00e1rio do sistema prisional brasileiro, valendo-se de uma pesquisa emp\u00edrica quantitativa, com fontes secund\u00e1rias, para elucidar o cen\u00e1rio do encarceramento em massa e tra\u00e7ar hip\u00f3teses, bem como afirma\u00e7\u00f5es sobre a l\u00f3gica do sistema punitivo e o crescimento das fac\u00e7\u00f5es criminosas. Resumo<\/h4>

This paper focuses on the analysis of the principle of State sovereignty over natural resources (PSNR) from the perspective of International Human Rights Law. The United Nations Declaration and the American Declaration on the Rights of Indigenous Peoples, which recognize their right to self-determination and the right to collective property, raise the hypothesis about the extension of the PSNR towards the recognition of the rights of indigenous peoples to exercise jurisdiction over their ancestral lands and territories. A documentary study of the origin and development of the PSNR has been carried out in relation to the right of self-determination of peoples and it is concluded that in a non-colonial context, indigenous peoples are holders of that right and that the right to their territories, to Land and natural resources are elements of the PSNR, which is the basis of its political and economic autonomy. This paper examines the project-based pattern of European Southern Neighbourhood engagement in the European Research Area. Thereby, this study informs about the role of the European Research Area in advancing EU objectives and ambitions in the enduringly salient European Neighbourhood Policy context. The research question that drives this study is: What project archetypes’ pattern denotes the European Southern Neighbourhood’s participation in the pan-European space intended to facilitate the free flow of talent and ideas? The guiding hypothesis anticipates that the prevailing archetype corresponds to an encounter lasting for one project, and prolonged engagement throughout several consecutive projects is a rarity.\u00a0This enquiry into the relationality weaved by research collaboration formulates four archetypes. The main empirical material employed to model and study the four archetypes is semi-structured interviews with Europe-based project managers. Insights offered by the leading figures of projects funded by Framework Programme 7 and Horizon 2020 reveal how multilateral research-driven ties contribute to post-Westphalian external action aspirations. Devised analytic narratives attest to the performances of the EU science diplomacy, for example, in the form of technoscientific gifts as well as sharing and jointly developing kn\/own\/ables. Expert experiences of co-developing research-intensive solutions with Morocco- and Tunisia-based colleagues to address the most pressing challenges faced by the EU and its Southern neighbours are resourceful. They offer new insights into the patterned routines that support the implementation of such supranationally steered governance frameworks as the European Research Area, including its external action and science diplomacy dimensions. Almost half of the studied projects correspond to the archetype with one EU-funded project interaction. This confirms the rather sporadic or ad hoc relational ties of the European Southern Neighbourhood to the European Research Area, facilitated by various Europe-based competence centres.<\/p>

On May 21, 2024, the International Tribunal for the Law of the Sea issued its advisory opinion in the context of the issues submitted for opinion by the Commission of Small Island States on climate change and international law; This opinion constitutes a foundational reference for international law regarding the obligations of States in environmental matters and the fight against Climate Change in the seas and oceans.
