Observatory on European Studies

The Observatory on European Studies (ISBN 978-65-86439-56-4) is a dynamic and democratic space for communication on current issues and news concerning European integration in its most different facets and, mainly, its impacts and relations with Latin America.

The Observatory prioritizes the publication of news, insights related to European legal and political events and brief comments on European case law that generate interest to the international community. It also seeks to stimulate the dissemination of experiences and good practices in the area of regional and European integration, as an important tool for developing the concepts of international legal and political cooperation.

To submit a publication to the Observatory on European Studies, the author must follow the rules contained in the Submissions page and in the Guidelines for Authors. The publication will be analyzed by the Editorial Board and the decision will be communicated to the author.

    La guerra en Ucrania ha puesto de cabeza a la Comunidad Internacional. Acusaciones de genocidio se han hecho por ambas partes. Ucrania ha interpuesto un procedimiento ante la Corte Internacional de Justicia en contra de Rusia, argumentando que las operaciones militares hechas en Ucrania est√°n basadas en una incorrecta aplicaci√≥n e interpretaci√≥n de la Convenci√≥n para la Prevenci√≥n y la Sanci√≥n del Delito de Genocidio (CPSDG) y un abuso del derecho para prevenirlo, incluyendo la facultad de intervenir en el territorio de otro Estado, algo no contemplado por la Convenci√≥n. A su vez, Rusia contradice estos argumentos aduciendo a un supuesto genocidio en Luhansk y Donetsk y las obligaciones internacionales de prevenci√≥n, sanci√≥n y juzgamiento. Lo sorprendente de este caso, no resulta ser solo la demanda, por el sino, adem√°s, todas las invocaciones del Art 63 del Estatuto de la Corte Internacional de Justicia que han hecho, en su mayor√≠a pa√≠ses de la Uni√≥n Europea para ser intervinientes en el caso, siendo Hungr√≠a el √ļnico pa√≠s de la UE que no ha presentado una declaraci√≥n de intervenci√≥n.     Bajo el lema de ‚ÄúUna Uni√≥n que se mantiene firme y unida‚ÄĚ, la Comisi√≥n Europea acaba de presentar su programa de trabajo para 2023 -Estrasburgo, 18.10.2022 COM (2022) 548 final-. En el Pre√°mbulo de este documento se pone de manifiesto como Europa y el mundo han asistido en el √ļltimo a√Īo a la brutal invasi√≥n de Ucrania por parte de Rusia, lo cual ha llevado a un tr√°gico balance de p√©rdida de vidas humanas y de devastaci√≥n, adem√°s de provocar una crisis energ√©tica en el resto del mundo, con una fuerte presi√≥n sobre el coste de la vida, que ha frenado el proceso de recuperaci√≥n tras la pandemia.     The Project Jean Monnet Network - BRIDGE, co-funded by the Erasmus+ Programme of the European Union, and the Latin-American Center for European Studies invite young Latin American researchers to submit their works to the ‚ÄúMonograph Contest For Young Latin American Researchers - Jean Monnet Award‚ÄĚ, whose main objective is to foster excellence in research on topics related to European integration and/or its relationship with Latin America.¬†

    Only unpublished monographs submitted by YOUNG RESEARCHERS WHO ARE UP TO 35 YEARS OLD in 2023 will be accepted. AUTHORS MUST ALSO BE ENROLLED IN ANY HIGHER EDUCATION INSTITUTION IN LATIN AMERICA or HAD BEEN ENROLLED IN THE PAST 18 (EIGHTEEN) MONTHS. 

    Monographs (between 60-120 pages) written in English, Spanish or Portuguese will be accepted and authors must submit their monographs by 1 August 2023.

    Observatory on European Studies - CONVENÇÃO 190 DA ORGANIZAÇÃO INTERNACIONAL DO TRABALHO

    Com o objetivo de promover o trabalho decente, impulsionar a justi√ßa social e assegurar a igualdade nas rela√ß√Ķes de labor, o centen√°rio da Organiza√ß√£o Internacional do Trabalho foi marcado pela aprova√ß√£o, em 10 de junho de 2019, de um importante diploma normativo: a Conven√ß√£o sobre a Elimina√ß√£o da Viol√™ncia e do Ass√©dio no Mundo do Trabalho - Conven√ß√£o 190 da OIT.

    Observatory on European Studies - A insurrei√ß√£o da pra√ßa dos tr√™s poderes: algumas considera√ß√Ķes sobre a responsabiliza√ß√£o penal

    Neste domingo 8 de janeiro de 2023 ocorreu o maior atentado √†s institui√ß√Ķes pol√≠ticas da hist√≥ria do Brasil. Em nenhum momento da monarquia e da rep√ļblica, em per√≠odos de democracia ou autoritarismo, houve algo parecido. As sedes dos tr√™s poderes foram simultaneamente depredadas e inutilizadas por tempo indeterminado. Trata-se de um evidente caso de insurrei√ß√£o, crime pol√≠tico por excel√™ncia. Hoje este delito est√° previsto no novo artigo 359-L do c√≥digo penal, denominado ‚ÄúAboli√ß√£o violenta do Estado Democr√°tico de Direito‚Äú enquanto CRIMES CONTRA AS INSTITUI√á√ēES DEMOCR√ĀTICAS: ‚ÄúArt. 359-L. Tentar, com emprego de viol√™ncia ou grave amea√ßa, abolir o Estado Democr√°tico de Direito, impedindo ou restringindo o exerc√≠cio dos poderes constitucionais: Pena ‚ÄĒ reclus√£o, de quatro a oito anos, al√©m da pena correspondente √† viol√™ncia". De fato, tentou-se com viol√™ncia (p. ex., agress√£o efetiva dos manifestantes contra os policiais) abolir o estado democr√°tico (pois queriam a ‚Äúinterven√ß√£o militar‚ÄĚ) criando restri√ß√£o ao exerc√≠cio dos poderes constitucionais (executivo e judici√°rio tiveram seus pal√°cios completamente inutilizados no espa√ßo interno, e o legislativo, em particular o senado, bastante danificado). Dogmaticamente, h√° quem discuta se uma a√ß√£o como esta seria uma tentativa id√īnea para ‚Äúabolir‚ÄĚ (exterminar por completo) o estado de direito. A jurisprud√™ncia do STF, a partir do caso Daniel Silveira, tem dado interpreta√ß√£o mais flex√≠vel, sob pena de inutilidade do tipo penal. H√° uma s√©rie de crimes que complementam o quadro dos fatos ocorridos na Pra√ßa dos Tr√™s Poderes. √Äqueles que estavam ‚Äúapenas‚ÄĚ ostentando cartazes ou bradando dizeres favor√°veis √† tal ‚Äúinterven√ß√£o militar‚ÄĚ cometeriam o delito de incita√ß√£o previsto no par√°grafo √ļnico do artigo 286, tamb√©m do CP. N√£o me parece caber o delito de ‚Äúgolpe de estado‚ÄĚ (artigo 359-M do CP), visto que nenhum membro do governo (presidente, ministros etc.) foi efetivamente amea√ßado (n√£o houve, p. ex., tentativa de invas√£o do minist√©rio da justi√ßa, onde o ministro estava preparando a contra-ofensiva). Restam ainda os crimes de dano ao patrim√īnio p√ļblico em geral (artigo 163, CP) e tamb√©m patrim√īnio cultural (artigo 62 e seguintes da lei de crimes ambientais), tendo em vista a depreda√ß√£o de obras de arte, mob√≠lia hist√≥rica e mesmo os edif√≠cios projetados por Oscar Niemeyer. Tamb√©m caberia o crime de organiza√ß√£o criminosa (artigo 288, CP) mesmo para quem estava √† dist√Ęncia, o que inclui financiadores, apoiadores etc. Lembre-se que alguns desses crimes podem ser cometidos n√£o apenas por a√ß√Ķes, mas por omiss√£o dolosa, quando se atua de modo conivente (como no caso de alguns policiais que em vez de barrar os manifestantes, permitiam que eles tivessem acesso aos locais), sem falar no crime espec√≠fico de prevarica√ß√£o (artigo 319, CP). Pelo fato de o delito de ‚Äúinsurrei√ß√£o‚ÄĚ ser crime pol√≠tico, h√° uma s√©rie de quest√Ķes especiais previstas na constitui√ß√£o e nas leis. A investiga√ß√£o fica a cargo da pol√≠cia federal. Ser√£o julgados pela justi√ßa federal de primeira inst√Ęncia, mas eventuais apela√ß√Ķes, analisadas diretamente pelo STF. Se cometidos por grupos armados, s√£o insuscet√≠veis de anistia, gra√ßa e indulto (verificou-se furto de armas no gabinete do GSI, mas n√£o se viu por ora a constitui√ß√£o de mil√≠cias - art. 288-A, CP). E algo importante para o caso: n√£o s√£o pass√≠veis de extradi√ß√£o. Ainda que por ora parece incerta a participa√ß√£o direta do ex-presidente Bolsonaro, tamb√©m se encontra nos EUA o ex-ministro da justi√ßa e at√© ent√£o secret√°rio de seguran√ßa do DF, Anderson Torres, que deveria ter organizado a seguran√ßa da manifesta√ß√£o, impedindo o resultado ocorrido. Neste caso, parece dif√≠cil escapar do car√°ter pol√≠tico do crime e conseguir efetivar a extradi√ß√£o: seja pela regra da preponder√Ęncia (cl√°usula su√≠√ßa) como do tratamento humanit√°ria (cl√°usula francesa), apenas afastando completamente os crimes trazidos pela lei n. 14.197/2021 poderia se pedir ao governo norte-americano a entrega para processamento no Brasil. O que pode acontecer seria a expuls√£o destas pessoas daquele pa√≠s, o que √© uma quest√£o de direito p√ļblico, n√£o penal. Importante, n√£o se fale de terrorismo, o que possibilitaria a extradi√ß√£o. Neste e em casos semelhantes tal enquadramento √© incab√≠vel, pois no nosso pa√≠s n√£o existe mais a modalidade de terrorismo pol√≠tico: a lei prev√™ tal denomina√ß√£o apenas casos de para xenofobia, fundamentalismo religioso e racismo. Al√©m disso, outras consequ√™ncias: o c√≥digo penal impede a reincid√™ncia geral, e a lei de execu√ß√£o penal desobriga os condenados por tais crimes ao trabalho. Enfim, este caso parece ser o limiar para se decidir sobre a viabilidade de se ter um conjunto t√£o enxuto de crimes contra o Estado em tempos de grande polariza√ß√£o pol√≠tica. A op√ß√£o da lei de defesa do estado democr√°tico √© diferente da tradi√ß√£o liberal dos c√≥digos penais do imp√©rio e da rep√ļblica, e da tradi√ß√£o autorit√°ria das leis de seguran√ßa nacional de Vargas e da ditadura militar. Em ambos os casos havia muitos tipos penais bem detalhados. Talvez parecesse muito trabalho para uma democracia, ou ent√£o um resqu√≠cio de autoritarismo ter muitos crimes desta natureza. Por outro lado, uma lei mais detalhada permitiria um enquadramento mais preciso e uma puni√ß√£o mais adequada para as v√°rias grada√ß√Ķes de atos antidemocr√°ticos cometidos em uma situa√ß√£o extrema como a vivida neste domingo de vandalismo verde-amarelo. A esperar se os tr√™s poderes, cada um dentro de sua fun√ß√Ķes, propor√£o melhorias ao sistema de prote√ß√£o de nossa democracia e suas institui√ß√Ķes.

    Observatory on European Studies - Towards a single EU concept of security supply in the natural gas sector?

    In the past the fragmentation of the EU internal market in natural gas was founded on different reasons.

    Some related to the introduction of territorial restrictions (or comparable provisions such as profit sharing mechanisms) by upstream sellers in supply contracts that were able to block arbitrage between low price areas and high price areas within the EU.[1]

    Following several cases, such as the Gazprom[2] or the Qatarenergy[3], it’s clear that these clauses are forbidden under EU competition law rules.

    Furthermore, and until recently, the internal market in natural gas didn¬īt work properly due to geographical reasons ‚Äď knowing that many Member States are not interconnected or due to the structure of the markets ‚Äď vertically integrated ‚Äď or to the extreme dependency on some foreign states suppliers ‚Äď such as Russia.[4] [...]

    The Latin American Journal of European Studies's 4th issue is published!

    View Vol. 2 No. 2 (2022): Latin American Journal of European Studies

    The fourth issue of the Latin American Journal of European Studies has just been published. It is a publication of the Latin American Center of European Studies, created by the BRIDGE Project of Jean Monnet Network with funding from the Erasmus + Program of the European Commission. 

    The main purpose of the Journal is to publish research related to the European Union Law and Policies and International Relations of the European Union with third countries and Latin America to create new knowledge, build bridges of dialogue, as well as exchange good practices between European Union and Latin America. 

    The fifth issue of the Journal is open to submission until May 1th, 2023 and contains a thematic dossier on "Private International Law in relations between the European Union and Latin America".

    Organizado pelo Jean Monnet Network ‚Äď BRIDGE Project, coordenado pela professora Aline Beltrame de Moura, em parceria pela Federa√ß√£o das Ind√ļstrias de Santa Catarina (FIESC), o evento tamb√©m recebeu o apoio do Centro de Excel√™ncia Jean Monnet da Universidade Federal de Minas Gerais e do M√≥dulo Jean Monnet da Universidade Federal do Cear√°.

    Longos debates atravessaram s√©culos quando a discuss√£o girava sobre o papel dos animais na qualidade de objetos de estudo e de uso em experimentos laboratoriais. Arist√≥teles definia os animais como seres inferiores, circunst√Ęncia que justificou posi√ß√£o hier√°rquica desfavor√°vel e sua manipula√ß√£o em prol do conhecimento e da ci√™ncia. O s√©culo XVII, por sua vez, foi marcado pela teoria utilitarista de Descartes, o qual sustentava a gritante separa√ß√£o entre corpo e alma, culminando na impossibilidade de atribui√ß√£o de sensa√ß√Ķes aos animais e na nega√ß√£o da consci√™ncia e do ju√≠zo, resultando na nega√ß√£o do sofrimento e da express√£o.¬†

    Os debates sobre bem-estar animal avan√ßaram sobretudo a partir do s√©culo XX, especialmente nos anos 70. Os animais passaram a ocupar lugar de destaque no plano √©tico, moral, jur√≠dico e pol√≠tico, sendo a sua prote√ß√£o e defesa parte da constru√ß√£o das rela√ß√Ķes √©tica-humanas. Peter Singer retomou o utilitarismo de Jeremy Bentham, reformulando-o com suas pr√≥prias bases, publicando ‚Äď em 1975 ‚Äď ‚ÄėLiberta√ß√£o Animal‚Äô; e, posteriormente, ‚Äė√Čtica Pr√°tica‚Äô e ‚ÄėVida √Čtica, juntamente com Tom Regan. It is important to highlight that in 1992, the city of Rio de Janeiro hosted the United Nations Conference on Environment and Development and, twenty years later, hosted the United Nations Conference on Sustainable Development. Ever since, the country has had an important voice on international fora, expressing its position on the correlation between the global south, environmental protection and sustainable development.     Observatory on European Studies - A Federação Russa perde o status de Estado-parte da Convenção europeia dos Direitos do Homem

    Ap√≥s ter tido suspendidos os pr√≥prios direitos de representa√ß√£o diante dos principais √≥rg√£os do Conselho da Europa (CdE) em 25 de fevereiro de 2022, com base na Resolu√ß√£o CM/Del/Dec (2022) 1426 bis/2.3, a Federa√ß√£o Russa comunicou formalmente sua retirada da Organiza√ß√£o e sua ren√ļncia √† Conven√ß√£o Europeia de Direitos Humanos (CEDH) em 15 de mar√ßo. No dia seguinte, o Comit√™ de Ministros adotou a Resolu√ß√£o CM/(2022)2 segundo a qual, em conformidade com os arts. 3 e 8 do Estatuto, a R√ļssia foi imediatamente exclu√≠da do Conselho da Europa.     Observatory on European Studies - Situación de Macedonia del Norte Frente a la UE

    Como es bien sabido, históricamente Macedonia, no formaba parte de Grecia, que en tiempos ancestrales, se trataba de ciudades Estado, es decir, no se trataba de un país unificado.

    Macedonia estaba situada al norte de las Ciudades Estado (ahora Grecia), entre los
    territorios de Epiro, Iliria, Peonia y Tracia. La región había permanecido aislada de las
    polis, es más, la mayoría los habitantes de las ciudades estado, la consideraban una más
    de la comunidades no griegas o b√°rbaras del norte.

    Sin ahondar en la historia, es de recordarse que las ciudades Estado participaron en
    m√ļltiples batallas y guerras (Salamina, Platea y M√≠cala) contra los Persas, quienes hab√≠an
    invadido tales tierras, así como las Guerras Médicas, lidereadas por Atenienses y
    Espartanos, no significa que Grecia, fuese un país así conformado. Es más la historia
    registra la guerra del Peloponeso sucedida entre los a√Īos 431 y 404 a. C., en la cual
    Esparta pone fin a la supremacía del Imperio ateniense. [...]

    More than 200 people attended the IV Jean Monnet Network Meeting - BRIDGE Project at the Universidad del Rosario, Colombia

    Universidad del Rosario (Bogotá, Colombia) hosted the IV Jean Monnet Network Event of the Bridge Project on the theme "Dialogues on economic and sustainable development between the EU and third countries". Between October 3rd and 5th, 2022 the Bridge Project, funded by the Erasmus+ Program of the European Union, carried out a series of academic activities at the Law Faculty of the Universidad de Rosario, Colombia, supported by Academia Colombiana de Derecho Internacional. Participants and speakers were able to attend the three-day event both in person and virtually.  

    On October 03, 2022, the institutional partners from Universidade Federal de Santa Catarina (Brazil), Universidade de Lisboa (Portugal), Universidad de Sevilla (Spain), Università degli Studi di Milano (Italy), Universidad Nacional Autónoma de México (Mexico), Universidad de Buenos Aires (Argentina), Universidad del Rosario (Colombia) hosted an internal meeting to discuss the results of the project so far and the activities to be developed in the next year.  

    At 3pm, the Round Table on "Arbitraje internacional y relaciones econ√≥micas desde el derecho internacional p√ļblico y privado" has taken place, counting the follow panels: An√°lisis comparado de la protecci√≥n de las expectativas leg√≠timas en el arbitraje internacional de inversiones y en Colombia (Rafael Tamayo, Universidad del Rosario); Mecanismos de soluci√≥n de controversias en los acuerdos de libre comercio de la Uni√≥n Europea con terceros pa√≠ses (Aline Beltrame de Moura, Universidad Federal de Santa Catarina);¬† El arbitraje "sui generis" en el acuerdo UE-Mercosur (Sandra Negro, Universidad de Buenos Aires); Aspectos elementares na expropria√ß√£o indireta utilizados pela International Centre for Settlement of Investment Disputes (ICSID) nas arbitragens de investimento da Am√©rica Latina (Joana Stelzer, Universidad Federal de Santa Catarina); La apertura de la Uni√≥n Europea a mecanismos globales de resoluci√≥n de controversias en el sector de la contrataci√≥n internacional (Beatriz Campuzano D√≠az, Universidad de Sevilla); Autonom√≠a de las partes y elecci√≥n de la ley aplicable al contrato desde una perspectiva de derecho comparado (Naiara Posenato, Universit√° degli Studi di Milano); La propiedad intelectual y la soluci√≥n de controv√©rsias (Manuel Becerra Ram√≠rez, Instituto de Investigaciones Jur√≠dicas, UNAM); Judicial review of the new EU Regulation on foreign subsidies (Nuno Cunha Rodrigues, Universidade de Lisboa).

    Afterwards, at 5pm, Professor Manuel Becerra Ramírez released the book "Latin American cases before the International Court of Justice: Borders, armed conflicts, human rights and the environment" coordinated by him and published by Universidad Nacional Autónoma de México.

    On October 4th, at 9:00 am, the Bridge Project hosted its IV Seminar on "Dialogues on economic and sustainable development between the EU and third countries". Opening speeches counted with the words of José Alberto Gaitán, Decano - Facultad de Jurisprudencia Universidad del Rosario; Laura Victoria García-Matamoros, Vicedecana - Facultad de Jurisprudencia Universidad del Rosario; Sonia Tato, Jefe adjunta de cooperación de la UE en Colombia; Aline Beltrame de Moura, Project Coordinator - Universidade Federal de Santa Catarina; and Walter Arevalo, partner from Universidad de Rosario.

    In the main panel, addressing the theme of the event, the Seminar counted on the participation of authorities and experts on the matter, which spoke about their experience and studies: Alejandro Linares Cantillo (Magistrado de la Corte Constitucional Colombiana); Sonia Tato (Jefe adjunta de cooperación de la UE en Colombia); Mikkel Hall (Consejero de la Embajada de Dinamarca en Bogotá); and Jennyffer Vargas (Subdirectora de la Fundación ACUA).

    On the same day in the afternoon, the IV Workshop "Dialogues on economic and sustainable development between the EU and third countries" gave space to the presentation of 15 papers written by authors from countries like Colombia, Brazil, Argentina, Switzerland and Germany. Papers were selected through Call for Papers. By the end of October, the two best papers selected by the Commission will be awarded with the value of EUR 250 each.

    The last proposed activity took place on October 5th. The Course for Public Agents started at 08:00 addressing the regional integration process of the European Union and its impact on the provision of legal assistance in Latin America. The students for the course included the officers from Escuela Militar de Cadetes General José María Córdova (ESMIC), Universidad Militar Nueva Granada, Armada Nacional de Colombia and students from Universidad del Rosario. 

    The partners of the project taught classes on European Union and Latin America-related themes to more than 100 participants.

    More than 200 people participated in the 3 days of event, both online and in person at Universidad del Rosario.

    IV Jean Monnet Network Seminar - University of Rosario, Colombia

    Between October 3rd and 5th, 2022 the Jean Monnet Network - BRIDGE, project funded by the Erasmus+ Program of the European Union, will carry out a series of academic activities in the IV Meeting of the Jean Monnet Network - BRIDGE at the Law Faculty of the Universidad de Rosario, Bogot√°, Colombia, with the central theme: "Dialogues on economic and sustainable development between the EU and third countries". All activities will take place in hybrid mode (face-to-face and via Zoom).

    On March 03, 2022, at 3pm (GMT -05:00), the Round Table on "Arbitraje internacional y relaciones econ√≥micas desde el derecho internacional p√ļblico y privado" will take place. Afterwards, at 5pm, there will be the launch of the book "Latin American cases before the International Court of Justice: Borders, armed conflicts, human rights and the environment" coordinated by Manuel Becerra Ram√≠rez, published by the publisher of the Universidad Nacional Aut√≥noma de M√©xico.

    On the 4th, at 9:00 am (GMT -05:00) we will have the Seminar on "Dialogues on economic and sustainable development between the EU and third countries".     In addition, to finalize the proposed activities, on October 5th, starting at 08:00 (GMT -05:00), the Training Course on "El proceso de integración regional de la Unión Europea y su impacto en la prestación de asistencia jurídica en América Latina" will be held for Army officers and the general public. The session will take place in person at the University of Rosario and virtually (via Zoom), and is supported by the Escuela Militar de Cadetes de Bogotá (ESMIC).

    Reflexionar sobre las diferentes formas de construir puentes debe ser una obligación para quienes trabajamos con migración, bueno, en general para quienes trabajamos con personas y con sus derechos fundamentales.

    La construcción, reconstrucción y deconstrucción de fronteras en Europa tiene un largo pasado, pero a partir del final de la Segunda Guerra Mundial se buscó la integración como una medida para respaldar un proceso de paz. Un elemento innovador para su época fue que, más que concebir la integración como la desaparición de los diferentes países, se planteó como la creación de normas y compromisos comunes que le permitieran a cada país conservar su autonomía y marco jurídico propio. Las fronteras entre los estados se conservaron, pero se tendieron puentes legales que ahora permiten transitar libremente entre naciones.

    Los puentes entre las naciones europeas empezaron por lo b√°sico. En un principio el acuerdo era √ļnicamente comercial, circunscrito a dos productos b√°sicos y s√≥lo unas cuantas naciones suscribieron el Tratado de Par√≠s, en 1952, formando la Comunidad Europea del Carb√≥n y el Acero. [...]

    When World War II ended, Europe was in ruins and was ‚Äúsqueezed‚ÄĚ between US military power on the other side of the Atlantic and Soviet military power on the eastern side of the continent. Until the dismantling of the Soviet Union in mid-1991, the world was militarily polarized between the United States and the Soviet Union, and the Europeans were simply supporting actors in the Cold War.

    Today, we live in a more multipolar world in terms of military might. The US remains the biggest military power in the world, especially in terms of spending. China already ranks second in military spending. In addition, India and the UK continue to advance their defence and security budgets. Russia, once diminished by the fall of the Soviet Union, has rebuilt its military power under Putin. [...]

    Result: II Contest ‚ÄúMonograph Contest for Young Latin American Researches ‚Äď Jean Monnet Award"

    The organizing committee of the ‚ÄúII Monograph Contest For Young Latin American Researchers ‚Äď Jean Monnet Award", an initiative of the Jean Monnet Network project ‚ÄúBuilding RIghts and Developing Knowledge between the European Union and Latin America ‚Äď BRIDGE Project‚ÄĚ, co-financed by the Erasmus+ Program of the European Union, and the Latin American Center for European Studies is honored to announce the result of the second edition of this competition.

    Sofia Frischenbruder Sulzbach, an undergraduate student in Law at the Federal University of Rio Grande do Sul, was the winner of this edition of the competition. Author of the monograph entitled¬† DIREITO E POL√ćTICAS RELACIONADAS A OBRAS GERADAS POR INTELIG√äNCIA ARTIFICIAL NO BRASIL E NA UNI√ÉO EUROPEIA, Sofia will receive the equivalent prize of 1,000.00 (one thousand) Euros for being the best classified among the contestants, the paper will be published in the form of an article in the journal ‚ÄúLatin American Journal of European Studies‚ÄĚ.

    The Honorable Mention was won by¬† Ana Vict√≥ria Klovrza Diogo, Master's student in International Relations at the Federal University of Uberl√Ęndia, with the monograph AS HABITANTES DA FRONTEIRA: AS DEFICI√äNCIAS DAS POL√ćTICAS P√öBLICAS DE ACOLHIMENTO A REFUGIADOS NA UNI√ÉO EUROPEIA E SEUS IMPACTOS PARA MULHERES REFUGIADAS, the paper also will be published in the journal ‚ÄúLatin American Journal of European Studies‚ÄĚ.

Nesta data houve a entrega de um Relat√≥rio final, com 49 propostas al√©m de 326 medidas espec√≠ficas, aos Presidentes do Parlamento europeu, do Conselho e da Comiss√£o europeia.     Observatory on European Studies - A green rhetoric? The European energy transition faces greenwashing challenges

    Despite the serious concerns surrounding climate change and international efforts to curb its nefarious effects, the instances in which greenwashing persists as an ongoing threat to such efforts remain mostly unchallenged. Greenwashing may be understood as an attempt to divert the attention of stakeholders in various relevant decision-making environments (e.g. public policy-making forums, Board of Directors meetings across industries, etc.) from a sincere engagement with concrete actions to the mere adoption of a climate-friendly rhetoric. This rhetoric may even materialize itself with an appearance of serious commitment to reach certain measurable targets, while such metrics are opaque and convey very little information as to the real impacts of the actions undertaken by a government, company, or any other stakeholder.     El pr√≥ximo 1 de agosto comenzar√° a aplicarse el Reglamento (UE) 2019/1111 del Consejo, de 25 de junio de 2019, relativo a la competencia, el reconocimiento y la ejecuci√≥n de resoluciones en materia matrimonial y de responsabilidad parental, y sobre la sustracci√≥n internacional de menores (versi√≥n refundida), que viene a sustituir al Reglamento (CE) 2201/2003 del Consejo, de 27 de noviembre de 2003, relativo a la competencia, el reconocimiento y la ejecuci√≥n de las resoluciones judiciales en materia matrimonial y de responsabilidad parental, por el que se deroga el Reglamento (CE) n√ļm. 1347/2000. Se trata de una renovaci√≥n importante, dado que esta norma se ocupa de materias como las crisis matrimoniales, las cuestiones de responsabilidad parental y los supuestos de secuestro internacional de menores. Estamos adem√°s ante una norma que constituye el n√ļcleo del derecho de familia de internacional desarrollado por la UE, pues como complemento, y para dar una respuesta de conjunto a las crisis matrimoniales, se han aprobado el Reglamento (CE) 4/2009 del Consejo, de 18 de diciembre de 2008, relativo a la competencia, la ley aplicable, el reconocimiento y la ejecuci√≥n de las resoluciones y la cooperaci√≥n en materia de obligaciones de alimentos y el Reglamento (UE) 2016/1103 del Consejo, de 24 de junio de 2016, por el que se establece una cooperaci√≥n reforzada en el √°mbito de la competencia, la ley aplicable, el reconocimiento y la ejecuci√≥n¬† de resoluciones en materia de reg√≠menes econ√≥micos matrimoniales. Este √ļltimo Reglamento se aprob√≥ junto el Reglamento (UE) 2016/1104 del Consejo, de 24 de junio de 2016, por el que se establece una cooperaci√≥n reforzada en el √°mbito de la competencia, la ley aplicable, el reconocimiento y la ejecuci√≥n de resoluciones en materia de efectos patrimoniales de uniones registradas, a fin de dar una respuesta a la mayor diversidad de formas familiares existentes en la sociedad actual.     It has just been published the third edition of the Latin American Journal of European Studies that counts with 13 contributions on " Democracy and the protection of human rights in the European Union and Latin America". This is a publication of the Latin American Center of European Studies, created from the BRIDGE project of the Jean Monnet Network with funding from the Erasmus + Program of the European Commission.

    The main purpose of the Journal is to publish research related to the European Union Law and Policies and International Relations of the European Union with third countries and Latin America to create new knowledge, build bridges of dialogue, as well as exchange good practices between European Union and Latin America.

    The Project Jean Monnet Network - BRIDGE, co-funded by the Erasmus+ Programme of the European Union, and the Latin-American Center for European Studies invite young Latin American researchers to submit their works to the ‚ÄúMonograph Contest For Young Latin American Researchers - Jean Monnet Award‚ÄĚ, whose main objective is to foster excellence in research on topics related to European integration and/or its relationship with Latin America.¬†

    Only unpublished monographs submitted by YOUNG RESEARCHERS WHO ARE UP TO 35 YEARS OLD in 2022 will be accepted. AUTHORS MUST ALSO BE ENROLLED IN ANY HIGHER EDUCATION INSTITUTION IN LATIN AMERICA.

La aplicación para ser miembros de la UE se vio acelerada por el recrudecimiento del conflicto entre Ucrania y Rusia en el cual, Ucrania se ha visto afectada tanto en su soberanía como en la presunta comisión de crímenes de guerra en su territorio (que dio inició a un procedimiento cautelar ante la CIJ el pasado 16 de marzo), y en el que  Moldova y Georgia han visto la amenaza de ocupación territorial por parte de Rusia.     Digitaliza√ß√£o e acessibilidade podem ser melhoradas; no √ļltimo ano a percep√ß√£o da independ√™ncia judicial entre o p√ļblico em geral foi menor em mais da metade dos Estados-Membros.

    No m√™s de maio de 2022 a Comiss√£o europeia publicou o ‚ÄúPainel de avalia√ß√£o da Justi√ßa na Uni√£o Europeia de 2022‚ÄĚ (The 2022 EU Justice Scorebord), uma panor√Ęmica anual que desde 2013 fornece dados comparativos sobre a efici√™ncia, qualidade e independ√™ncia dos sistemas judiciais dos Estados-Membros. Este ano, pela primeira vez, foi considerado o impacto da Pandemia de Covid-19 sobre a efici√™ncia de tais sistemas judiciais. De um lado, existem os Projetos de Lei (PLs) brasileiras em discuss√£o: altera√ß√£o na demarca√ß√£o de √°reas ind√≠genas (PL 490); flexibiliza√ß√£o na aprova√ß√£o de agrot√≥xicos (PL 6.299); flexibiliza√ß√£o nas regras de licenciamento ambiental (PL 2.159); concess√£o de anistia √† grilagem de terras p√ļblicas (PL 2.633 e 510); e, libera√ß√£o de minera√ß√£o em terras ind√≠genas (PL 191) (essa, ali√°s, com car√°ter de urg√™ncia em decorr√™ncia da guerra na Ucr√Ęnia).     More than 2.700 people attended the III Jean Monnet Network Meeting

    More than 2.700 people attended the III Jean Monnet Network Meeting on the theme ‚ÄúDemocracy and the protection of human rights in the European Union and Latin America‚ÄĚ between March 28th and 30th of 2022. The Jean Monnet Network ‚Äď BRIDGE project, financed by Erasmus Program + from the European Union, performed its third event, which was held in Mexico City with the support of Universidad Nacional Aut√≥noma de M√©xico.¬†¬†

    On March 28th, 2022, at 10 am (MX time - GMT -05:00), the III Jean Monnet Network - BRIDGE Seminar discussed the theme ‚ÄúDemocracy and the protection of human rights in the European Union and Latin America‚ÄĚ. The Seminar was organized by the project in association with Instituto de Investigaciones Jur√≠dicas of Universidad Nacional Aut√≥noma de M√©xico, where the event took place. Participants and speakers were able to attend the event both in person and virtually.¬† ¬†

    The Seminar counted on the participation of authorities and experts on the matter, which spoke about their experience and studies on Democracy and the protection of Human Rights in the European Union and Latin America:¬†Ana Mar√≠a Guerra Martins, Judge at the European Court of Human Rights,¬†Gautier Mignot, Ambassador for the European Union in Mexico,¬†Juan Luis Gonz√°les Alc√°ntara, Minister at the Supreme Court of Justice of the Nation,¬†Leticia Bonif√°z Alfonzo,¬†Expert for the Committee for Elimination of Discrimination against Women ‚Äď Cedaw from UN,¬†Sergio Garc√≠a Ram√≠rez,¬†Former judge of the Interamerican Court of Human Rights,¬†Gl√≥ria Ramirez,¬†holder of Cat√©dra UNESCO in Human Rights at UNAM.

    On the same day, at 4 pm (MX time - GMT -05:00), the partners of the project held a Round of Discussions on ‚ÄúHuman Rights in Latin America and the European Union: comparative studies‚ÄĚ. The event was also held at Instituto de Investigaciones Jur√≠dicas of Universidad Nacional Aut√≥noma de M√©xico, where participants and speakers were able to attend the event both in person and virtually. As of this date, the Seminar has more than 1.100 views and the Round of Discussions has more than 600 views.

    On March 29th, 2022, from 10 am to 02 pm (MX time - GMT -05:00), the Instituto de Investigaciones Jur√≠dicas of Universidad Nacional Aut√≥noma de M√©xico held the III Workshop of the BRIDGE Project on ‚ÄúDemocracy and the protection of human rights in the European Union and Latin America‚ÄĚ, which feature the presentation of 15 articles previously selected through a¬†Call for Papers. Participants and speakers were able to attend the event both in person and virtually. In the upcoming weeks, the two best articles selected by the Committee will be awarded the value of EUR 250 each. As of this date, the Workshop has more than 900 views.

    On March 29th and 30th, 2022, the project also held its second Course for Public Agents at Centro Nacional de Derechos Humanos (CENADEH / Mexico).

    The course on ‚ÄúThe process of regional integration of the European Union and its impact on the provision of legal assistance in Latin America‚ÄĚ was offered to the employees of Centro Nacional de Derechos Humanos de la Comisi√≥n Nacional de Derechos Humanos and was also open to the external community.

    The partners of the project taught classes on European Union and Latin America-related themes to more than 100 participants. Participants were able to attend the event in person.   

    All of the developed activities are part of the Jean Monnet Network ‚ÄúBuilding Rights and Developing Knowledge between European Union and Latin America ‚Äď BRIDGE‚ÄĚ, a Project financed by Erasmus Program + of the European Union and coordinated by Universidade Federal de Santa Catarina (Brazil) with the following institutional partners: University of Lisbon (Portugal), University of Sevilla (Spain), University of Milan (Italy), National Autonomous University of Mexico (Mexico), University of Buenos Aires (Argentina), University of Rosario (Colombia).

    The Online Training Course on the European Union is now available

    The Training Course "The European Union's regional integration process and its impact on the provision of legal assistance in Latin America" offered by the Jean Monnet Network - BRIDGE project, co-financed by the Erasmus+ program of the European Union and by the Latin American Center of European Studies (LACES), is now available and completely free of charge.

    The objective of the course, available online, is to offer to public agents, legal and international relations operators and practitioners a greater understanding of how the European Union's regional integration process relates to Latin America, considering the complex legal issues involved and, in particular, its impact on legal assistance provided by Latin American countries‚Äč.‚Äč

    The course consists of seven classes taught by Latin American and European professors, who are partners of the BRIDGE project. The classes are  in Portuguese and Spanish (always with translation in the subtitles of the video), and totalize 10 hours. The course was recorded in October 2021, when it was offered in partnership with the Public Defender's Office (DPU) in Brazil.

    The collection of assignments presented here is the result of the II Workshop Jean Monnet Network ‚Äď BRIDGE on ‚ÄúMigration and Citizenship in the European Union and Latin America‚ÄĚ which took place on November 09, 2021, in hybrid mode (part face-to-face and part online), at University of Santa Catarina, Brazil. This initiative promoted an intense debate on the theoretical and practical aspects regarding migration and citizenship in European Union and Latin American countries, with the presence of professors and researchers from several universities.

    The proceedings are part of the activities developed by Jean Monnet Network project called ‚ÄúBuilding Rights and Developing Knowledge between European Union and Latin America - BRIDGE‚ÄĚ, co-financed by the Erasmus+ Program of European Commission (620744-EPP-1-2020-1-BR-EPPJMO-NETWORK), coordinated by Professor Aline Beltrame de Moura. The project encompasses the Federal University of Santa Catarina (Brazil); the Faculty of Law of the University of Lisbon; the University of Seville (Spain); the University of Milan (Italy); the National Autonomous University (Mexico); the University of Buenos Aires (Argentina) and the University of Rosario (Colombia).

    The articles presented at the II Workshop were previously evaluated through Call for Papers, launched in May 2021, and selected by the Organizing Committee composed of Professors Aline Beltrame de Moura (Federal University of Santa Catarina), Sandra Negro (Universidad de Buenos Aires, Argentina) e Elisa Chiaretto (Università degli Studi di Padova, Itália) and part of the articles selected for presentation at the Workshop were published in Anais do II Workshop Jean Monnet Network - BRIDGE  and the others will be published in the II edition of the Latin American Journal of European Studies (2021-2).

    En la Uni√≥n Europea disponemos de normas uniformes de competencia judicial internacional en materia civil y mercantil, que se acompa√Īan de un r√©gimen privilegiado de reconocimiento y ejecuci√≥n de resoluciones judiciales. Se trata de normas importantes, cuya elaboraci√≥n se remonta a los inicios del proceso de integraci√≥n europea, pues la seguridad jur√≠dica que proporcionan ha resultado fundamental para el desarrollo de las transacciones comerciales internacionales, y con ellas del mercado interior.     Universidade Federal de Santa Catarina hosts the II meeting of the Jean Monnet Network - BRIDGE

    On March 9, 2021, the Universidade Federal de Santa Catarina held the II Jean Monnet Network Seminar ‚Äď BRIDGE. Organized by professors Aline Beltrame de Moura, coordinator of the BRIDGE Project, and Sandra Negro from the Universidad de Buenos Aires, the conference addressed the theme ‚ÄúMigration and Citizenship in the European Union and Latin America‚ÄĚ.

    The event's activities were divided into two distinct moments: the debates promoted by the Seminar, which included the participation of various authorities specialized in the subject, and the presentation of the papers that took place at the Workshop, which brought together professors and researchers of different nationalities.

    The Seminar was attended by the Member of the European Parliament, Margarida Marques; Deputy Head of the European Union Delegation in Brazil, Ana Beatriz Martins; the Regional Policy and Coordination Officer of the International Organization for Migration (IOM - South America), Ezequiel Texidó; the Deputy Representative of the United Nations High Commission for Refugees (UNHCR) in Brazil, Federico Martinez; the Legal Adviser on Immigration at Unión Sindical Obrera in Spain, Max Adam Romero; and the former employee of Argentina's Dirección de Migraciones and professor at the Universidad Abierta Interamericana, Emiliano Bursese.

    The Workshop featured the presentation of 16 (sixteen) papers previously selected through the Call for Papers organized by the Scientific Committee composed of Aline Beltrame de Moura (Universidade Federal de Santa Catarina), Sandra Negro (Universidad de Buenos Aires) and Elisa Chiaretto, (Università degli Studi di Padova).

    The selected articles were written by researchers from 17 (seventeen) different universities. The presentation was divided into four panels moderated by professors Nuno Cunha Rodrigues (University of Lisbon), Beatriz Campuzano Días (Universidad de Sevilla) Joana Stelzer (Universidade Federal de Santa Catarina) Naiara Posenato (Università degli Studi di Milano) all members of the BRIDGE Project.

    The closing of the Workshop included considerations by Professor Walter Arévalo-Ramírez (Universidad del Rosario).

    The best articles will be published in the second edition of the Latin America Journal of European Studies and the first two articles, selected by the Organizing Committee, will also receive a prize equivalent to EUR 250 each. The other articles will be published in the Annals of the event organized by Editora Emais.

    II Jean Monnet Network - BRIDGE Seminar "Migration and Citizenship in the European Union and Latin America"

    On November 9, 2021, at 4 pm (BR time - GMT -03:00), the Faculty of Law of the Federal University of Santa Catarina will hold a virtually conference, called II Jean Monnet Network Seminar - BRIDGE ‚ÄúMigration and Citizenship in the European Union and Latin America‚ÄĚ.

    1st Edition of the training course - BRIDGE Projects

    The 1st Edition of the training course called¬†‚ÄúThe process of regional integration in the European Union and its impact on the provision of legal assistance in Latin America‚Ä̬†ended on Friday, October 22, 2021.

    The training course has been organizing by the Jean Monnet Network - BRIDGE Project, co-funded by the Erasmus+ Programme of the European Union, the Latin-American Center for European Studies - LACES, in partnership with the Escola Nacional da Defensoria P√ļblica da Uni√£o ‚Äď ENADPU (Brazil)

    The 10-hour course was taught by BRIDGE partner professors and was attended by more than 150 students from 14 countries, committed to understanding how the European Union's regional integration process relates to Latin America, considering the complex legal issues involved, and its impact on the provision of legal assistance by these countries.

    VIRTUAL TRAINING COURSE OPEN FOR REGISTRATION - JEAN MONNET BRIDGE

    The Project Jean Monnet Network - BRIDGE, co-funded by the Erasmus+ Programme of the European Union, the Latin-American Center for European Studies - LACES, in partnership with the Escola Nacional da Defensoria P√ļblica da Uni√£o ‚Äď ENADPU (Brazil), the entire academic community and other interested parties to participate in the training course ‚ÄúThe European Union's regional integration process and its impact on the provision of legal assistance in Latin America‚ÄĚ.

    The objective of the course is to examine the legislation and policies of the European Union in order to understand how this process of regional integration deals with complex legal issues that impact the provision of legal assistance offered in Latin American countries. Particularly, it is intended to identify the policies and legal instruments available to facilitate judicial cooperation and build new bridges of dialogue between the European Union and third countries, in particular, Latin American ones.

    The course will be taught virtually on the ENADPU platform with live classes on October 6th, 8th, 13th, 14th, 18th, 20th and 22nd, always from 10am to 12pm (Brasilia time). Subjects will be taught in Portuguese or Spanish.

    The Annals of the I Seminar Jean Monnet Network BRIDGE about ‚ÄúCommercial and investment relations between the European Union and Latin America‚ÄĚ are now available

    The collection of assignments presented here is the result of the I Workshop Jean Monnet Network ‚Äď BRIDGE on ‚ÄúCommercial and investment relations between the European Union and Latin America‚ÄĚ which took place on March 15, 2021, in virtual mode, at the European Institute of the Faculty of Law of the University of Lisbon. This initiative promoted an intense debate on the theoretical and practical aspects of partnerships between the European Union and Latin American countries in the sector of international trade and foreign investment, with the presence of professors and researchers from several universities.

    The proceedings are part of the activities developed by the C√°tedra Jean Monnet coordinated by Professor Nuno Cunha Rodrigues and by the Jean Monnet Network project called ‚ÄúBuilding Rights and Developing Knowledge between the European Union and Latin America ‚Äď BRIDGE‚ÄĚ, co-financed by the Erasmus+ Program of European Commission (620744-EPP-1-2020-1-BR-EPPJMO-NETWORK), coordinated by Professor Aline Beltrame de Moura.

    The articles presented at the Workshop were previously evaluated through Call for Papers, launched in November 2020, and selected by the Organizing Committee composed of Professors Nuno Cunha Rodrigues (University of Lisbon), Elizabeth Accioly (European University of Lisbon) and Aline Beltrame de Moura (Federal University of Santa Catarina). Part of the articles selected for presentation at the Workshop were published in Anais do I Semin√°rio Jean Monnet Network BRIDGE (PDF archive) and the others in the I edition of the Latin American Journal of European Studies (2021-1).

    Result: I Contest ‚ÄúMonograph Contest for Young Latin American Researches ‚Äď Jean Monnet Award"

    The organizing committee of the ‚ÄúI Monograph Contest For Young Latin American Researchers ‚Äď Jean Monnet Award", an initiative of the Jean Monnet Network project ‚ÄúBuilding RIghts and Developing Knowledge between the European Union and Latin America ‚Äď BRIDGE Project‚ÄĚ, co-financed by the Erasmus+ Program of the European Union, and the Latin American Center for European Studies is honored to announce the result of the first edition of this competition.

    Marcelo Terra Bento Martinelli, an undergraduate student in International Relations at the Federal University of Uberl√Ęndia, was the winner of this edition of the competition. Author of the monograph entitled O PACTO ECOL√ďGICO EUROPEU E SEUS EFEITOS SOBRE A COMUNIDADE INTERNACIONAL, Marcelo will receive the equivalent prize of 1,000.00 (one thousand) Euros for being the best classified among the contestants, the paper will be published in the form of an article in the journal ‚ÄúLatin American Journal of European Studies‚ÄĚ.

    The Honorable Mention was won by Victor Matheus de Santana Santos, Master's student in Political Science at the Federal University of Pernambuco, with the monograph AS ELEI√á√ēES DE 2014 PARA O PARLAMENTO EUROPEU: O CRESCIMENTO DA DIREITA EUROC√ČTICA E O DEBATE SOBRE ‚ÄúELEI√á√ēES DE SEGUNDA-¬† ORDEM‚ÄĚ the paper also will be published in the journal ‚ÄúLatin American Journal of European Studies‚ÄĚ.

    First issue of 2021’s Latin American Journal of European Studies

    The first issue of the Latin American Journal of European Studies has just been published. It is a publication of the Latin American Center of European Studies, created by the BRIDGE Project of Jean Monnet Network with funding from the Erasmus + Program of the European Commission. 

    The main purpose of the Journal is to publish research related to the European Union Law and Policies and International Relations of the European Union with third countries and Latin America to create new knowledge, build bridges of dialogue, as well as exchange good practices between European Union and Latin America. 

    The second issue of the Journal is open to submission until November 1st, 2021 and contains a thematic dossier on Migration and Citizenship in the EU and Latin America.

    On May 23 of 2021, Roman Protasevich, a journalist and well-known critic of Lukashenko‚Äôs regime and his girlfriend Sof√≠a Sapega, a law student, were traveling from Athens, Greece to Vilnius, Lithuania. Suddenly, their plans changed. Two KGB members that were on board allegedly reported ‚Äėa bomb‚Äô and forced the landing of the aircraft in Minsk, Belarus, even though they were already closer to Vilnius. In order to protect 171 passengers, the Ryanair Flight FR4978, escorted by an MiG-29, was diverted and landed in Minsk National Airport. After five hours searching for the bomb nothing was found and the plane was free to go. Nonetheless, without both Protasevich and Sapega, who were captured as terrorists. According to the BBC, the situation was just a stunt to imprison him, but it definitely affected other passengers while challenging both human rights law and international law [...]

    Con el nuevo Instrumento para la Vecindad, el Desarrollo y la Cooperaci√≥n Internacional (IVDCI) y el Marco Financiero Plurianual de 2014 a 2020 (MFP), la Uni√≥n Europea (UE) estableci√≥ un enfoque ‚Äúdiferenciado‚ÄĚ con el que busca ‚Äúgraduar‚ÄĚ a aquellos pa√≠ses que hayan mejorado su condici√≥n econ√≥mica, es decir, quienes sean identificados como pa√≠ses de renta media o media-alta. Esto con el objetivo de orientar mejor los recursos y cortar las subvenciones otorgadas por la Ayuda Oficial al Desarrollo (AOD) en donde supuestamente ya no sea necesaria. Sin embargo, esta clasificaci√≥n ignora la crisis social y econ√≥mica sobreviniente de los pa√≠ses que han recibido esta etiqueta y los restringe de recibir recursos que puedan ayudar a salir de esta situaci√≥n. De los 17 pa√≠ses graduados, 11 son latinoamericanos, lo cual expone la intenci√≥n de la UE de disminuir su presencia econ√≥mica en la regi√≥n. En definitiva, este t√©rmino no solo limita el avance de proyectos comunes entre ambos actores, sino que limita la cooperaci√≥n para el desarrollo promovida por la UE y relega a Am√©rica Latina y el Caribe (ALC), lo cual contrasta con el objetivo de la Agenda 2030 de no dejar a nadie atr√°s [...]

    En la Uni√≥n Europea, el Reglamento (CE) n√ļm. 2201/2003 del Consejo, de 27 de noviembre de 2003, relativo a la competencia, el reconocimiento y la ejecuci√≥n de las resoluciones judiciales en materia matrimonial y de responsabilidad parental, por el que se deroga el Reglamento (CE) n√ļm. 1347/2000, se ocupa de los supuestos de secuestro internacional de menores en varios de sus preceptos. Pero todos los Estados Miembros de la Uni√≥n Europea son parte tambi√©n de dos importantes Convenios internacionales, promovidos por la Conferencia de La Haya de Derecho Internacional Privado, que se ocupan igualmente de esta materia: el Convenio de La Haya de 25 de octubre de 1980 sobre los aspectos civiles de la sustracci√≥n internacional de menores; y el Convenio de La Haya de 19 de octubre de 1996 relativo a la competencia, la ley aplicable, el reconocimiento, la ejecuci√≥n y la cooperaci√≥n en materia de responsabilidad parental y de medidas de protecci√≥n de los ni√Īos.     Call for papers: II Jean Monnet Network ‚Äď BRIDGE Seminar at the Federal University of Santa Catarina

    The Jean Monnet Network ‚Äď BRIDGE project, cofunded by EU Erasmus+ Programme, and the Latin American Center of European Studies invite the academic community to submit scientific papers to the Workshop event of the II Jean Monnet Network Seminar on ‚ÄúMigration and Citizenship in the European Union and Latin America‚ÄĚ, which will be held virtually on the 9 November 2021, hosted by the Federal University of Santa Catarina (Brazil).

    The selected articles will be invited to publish in the Latin American Journal of European Studies or in the Collection of the Workshop.  The top two articles will also receive an award of EUR 250 each.

    Students perform European Council Simulation

    This Week began the European Council Simulation, promoted in the scope Jean Monnet Module, in the Law and Policies of the European Union subject, ministered by Dr. Aline Beltrame de Moura in the Universidade Federal de Santa Catarina (UFSC). During the two day simulation each group of students was representing a delegation of a EU member state and was debating the topic ‚ÄúFighting Disinformation in defense of Democratic Institutions‚ÄĚ to find solution for this issue.

    Webinar Series - "Experience of Legal Comparison"

    On the 21st, 26th, and 28th of April, three meetings were held as part of the Comparative Private Law of People and Markets course from the University of Milan focusing on the ‚ÄúExperience of Legal Comparison‚ÄĚ.

    It was a series of webinars designed to illustrate the practice of comparative law in different professional and institutional contexts:

    On April 21, Ana Flavia Sabi Rizelo talked about her experience with comparison as Para-Legal with the international law firm Leigh Day UK Law Firm, business / human rights protection sector.

    On Monday, April 26, the legal comparison activity carried out by the Italian Constitutional Court Studies Service was illustrated by its Director, Dr. Riccardo Nevola and the Head of the Comparative Law Sector, Prof. Paolo Passaglia.

    Finally, on April 28, Priscila Pereira de Andrade, Legal Officer at Unidroit, shared the experience of the prestigious International Institute for the Unification of Law, Unidroit.

    Observatory on European Studies _ Business and human rights arbitration: a potential procedural remedy for transnational human rights litigation involving European and Latin parties

    In 2015, dams owned by an Australian/British/Brazilian joint venture collapsed in the Brazilian city of Mariana affecting over 240,000 locals. Lawsuits were initiated before courts in Brazil, the United Kingdom and Australia seeking remedy for victims. However, the victim’s attorneys still struggle to overcome jurisdictional barriers and bring the claims before British and Australian courts, while Brazilian prosecutors face challenges to access fair compensation for rights-holders due government interreferences.     Observatory on European Studies _ The Association Agreement between the European Union and Mercosur and the environment: political and legal obstacles on the way forward

    The negotiations on the Association Agreement between the European Union (EU) and Mercosur (hereinafter, the ‚ÄėAgreement‚Äô) encompass three pillars: political dialogue, cooperation and trade. In June 2019, the two blocs reached an ‚Äėagreement in principle‚Äô on the trade pillar, after 20 years of negotiations. In June 2020, negotiations on the political and cooperation chapter were concluded. Despite this, the conclusion of the Agreement seems far from completion, since the text still needs to be finalised, signed and, finally, ratified in order to enter into force. As it is a ‚Äėmixed‚Äô agreement (its content falls within competences shared between the Member States and the European Union, and therefore is concluded between EU countries and the bloc as a whole), it must be ratified not only by the European Parliament, but also by each of the countries of the EU.
