Lawsuits were initiated before courts in Brazil, the United Kingdom and Australia seeking remedy for victims. However, the victim’s attorneys still struggle to overcome jurisdictional barriers and bring the claims before British and Australian courts, while Brazilian prosecutors face challenges to access fair compensation for rights-holders due government interreferences. Most victims had basic human rights violated, such as the right to housing, work and a healthy environment, and still lack access to remedies [...]

Observatory on European Studies _ The Association Agreement between the European Union and Mercosur and the environment: political and legal obstacles on the way forward

By Mariana Clara de Andrade, University of Milano-Bicocca

The negotiations on the Association Agreement between the European Union (EU) and Mercosur (hereinafter, the ‘Agreement’) encompass three pillars: political dialogue, cooperation and trade. In June 2019, the two blocs reached an ‘agreement in principle’ on the trade pillar, after 20 years of negotiations. In June 2020, negotiations on the political and cooperation chapter were concluded. Despite this, the conclusion of the Agreement seems far from completion, since the text still needs to be finalised, signed and, finally, ratified in order to enter into force. As it is a ‘mixed’ agreement (its content falls within competences shared between the Member States and the European Union, and therefore is concluded between EU countries and the bloc as a whole), it must be ratified not only by the European Parliament, but also by each of the countries of the EU. It is a process that involves political and legal hurdles in domestic, European and international law [...]

OBSERVATORY ON EUROPEAN STUDIES_ EU-NATO cooperation: a glimpse at the role of Eastern EU Members for keeping stability in Europe

Por Alexandre Zaporoszenko Cavazzani, Universidade Federal de Santa Catarina

Officially founded in 1949 by the Washington Treaty, with the aim at standing up for the Western world against the ascension of a new threat, the communism, NATO (North Atlantic Treaty Organization) has seen its role increase in the last decade. During the Cold War, NATO had the essential role of protecting the Western world against the attempts of the Soviet Union to take control over key-territories in Europe. After the Cold War and the fall of the Soviet Union, its works had to be redirected towards new threats such as terrorism, civil wars in the Middle East, and other punctual threats emerged from the end of bipolarization and rising of nationalism in many parts of the world [...]
