This article examines the role of the World Trade Organization\u2019s (WTO) Agreement on Technical Barriers to Trade (TBT Agreement) in addressing the regulatory challenges arising from the proliferation of artificial intelligence (AI) regulations. The objective is to assess how the TBT Agreement can facilitate international cooperation, enhance transparency, and mitigate regulatory fragmentation in the context of a “multilayered AI governance”. The methodology consists of a doctrinal analysis of the TBT Agreement\u2019s provisions – particularly those related to transparency, notification, and the use of international standards – supplemented by case studies of recent AI regulatory measures, such as the European Union (EU)\u2019s AI Act, and their treatment within the WTO system. The article also draws on WTO jurisprudence and empirical data on notifications and Specific Trade Concerns (STCs) to evaluate the practical application of the TBT framework to AI-related measures. The analysis demonstrates that the TBT Agreement\u2019s mechanisms – especially the notification process and the encouragement of the use of international standards – are increasingly relevant for AI regulation. The TBT Committee has emerged as a unique forum for the preemptive discussion and peer review of national AI regulations, enabling Members to identify and address potential trade concerns before they escalate. In conclusion, the article argues that the TBT Agreement provides valuable tools for improving AI governance and reducing regulatory fragmentation, but also underscores the need for further reforms to ensure its continued effectiveness in the context of emerging digital technologies.<\/p><\/section><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

This article addresses Standard Essential Patents (SEPs) and Fair, Reasonable and Non-Discriminatory (FRAND) licensing, which are fundamental to digital transformation and contemporary technological innovation. It provides an introduction to the concepts, characteristics, and legal and economic implications for the topic. The study analyses the Brazilian context, examining public policies implemented from the perspective of the National Intellectual Property Strategy (ENPI) Action Plans, as well as administrative decisions issued by regulatory bodies and judicial rulings at both state and federal levels, including landmark cases that have shaped the understanding of this matter in the country. It discusses central challenges such as the need for transparency in the declaration of essential patents, the determination of fair and reasonable royalties, and the impact of judicial decisions on the Intellectual Property ecosystem. The article seeks to debate solutions that adequately balance patent owners’ rights, the promotion of competition, and democratic access to technology, aligning with potential contributions to the Sustainable Development Goals (SDGs). En el marco del desarrollo de la econom\u00eda digital global, las Services Standards Essential Patents (SSEP) (o patentes esenciales a las normas t\u00e9cnicas de servicios) representan un fen\u00f3meno creciente caracterizado por patentes imprescindibles para la prestaci\u00f3n de servicios conforme a est\u00e1ndares t\u00e9cnicos internacionalmente aceptados. A diferencia de las Standard Essential Patents (SEP) tradicionales orientadas a productos, las SSEP se aplican a servicios intangibles donde la implementaci\u00f3n ocurre en entornos de software, redes de telecomunicaciones y plataformas digitales, como, por ejemplo, transmisi\u00f3n de datos, codificaci\u00f3n multimedia, autenticaci\u00f3n federada, interoperabilidad en la nube. Considerando este escenario, este art\u00edculo busca analizar los desaf\u00edos normativos relacionados con las SSEP en el Sistema Multilateral de Comercio, observando algunas implicaciones para el desarrollo de la econom\u00eda digital. Ante la carencia de un r\u00e9gimen que aborde los desaf\u00edos jur\u00eddicos que plantean las SSEP en el \u00e1mbito multilateral y la fragmentaci\u00f3n de algunos reg\u00edmenes dom\u00e9sticos que abordan el tema, se concluye que la incertidumbre jur\u00eddica y comercial para proveedores transfronterizos de servicios digitales amenaza con convertirse en una importante barrera no arancelaria que distorsiona el comercio internacional de servicios.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Resumen<\/h4>

Este art\u00edculo examina la compleja relaci\u00f3n entre la soberan\u00eda digital, los servicios e infraestructura en la nube y el derecho internacional, enfatizando c\u00f3mo los Estados buscan mantener la autonom\u00eda y el control regulatorio en un entorno digital globalmente interconectado. La soberan\u00eda digital se conceptualiza como aquella que abarca la autoridad legal, la independencia tecnol\u00f3gica y la gobernanza estrat\u00e9gica sobre los datos y la infraestructura. Dentro de este marco, la infraestructura digital en la nube surge como un motor esencial de la transformaci\u00f3n num\u00e9rica y, a la vez, como un vector de vulnerabilidad, ya que la dependencia de los Proveedores Globales de Servicios en la Nube redistribuye el control jurisdiccional y operativo. El estudio analiza el modelo de responsabilidad compartida que rige la seguridad en la nube, destacando la responsabilidad diferenciada entre proveedores y usuarios bajo las arquitecturas IaaS, PaaS y SaaS. Se explora c\u00f3mo los entornos h\u00edbridos y multi-nube aumentan la exposici\u00f3n a riesgos cibern\u00e9ticos, incluyendo el cibercrimen, el espionaje y el hacktivismo, al tiempo que desaf\u00edan las nociones tradicionales de atribuci\u00f3n y responsabilidad legal. Se presta especial atenci\u00f3n a la naturaleza de doble uso de la infraestructura en la nube, ya que los servicios comerciales son explotados cada vez m\u00e1s para operaciones cibern\u00e9ticas ofensivas, exfiltraci\u00f3n de datos y actividades de comando y control, tanto por actores no estatales como patrocinados por estados. Estas pr\u00e1cticas complican la aplicaci\u00f3n de los principios legales internacionales de soberan\u00eda, debida diligencia y responsabilidad estatal. Finalmente, el art\u00edculo sit\u00faa estas din\u00e1micas dentro del debate m\u00e1s amplio sobre la soberan\u00eda en la nube, contrastando el alcance extraterritorial de instrumentos como la Ley CLOUD de EE. UU. con el marco de la Reglamentaci\u00f3n General de la Protecci\u00f3n de Datos de la Uni\u00f3n Europea. Resumen<\/h4>

Este estudio tiene el objetivo de definir el enfoque que debe d\u00e1rsele a la Cooperaci\u00f3n Estrat\u00e9gica Digital entre la Uni\u00f3n Europea (UE) y Am\u00e9rica Latina y el Caribe (ALC), abordando oportunidades de integraci\u00f3n digital, transferencia tecnol\u00f3gica, innovaci\u00f3n sostenible y formulaci\u00f3n de pol\u00edticas conjuntas, mediante; una revisi\u00f3n del marco normativo del \u00e1mbito digital y el programa de la D\u00e9cada Digital Europea desarrollado en la UE. A su vez, estudia los antecedentes de las relaciones entre la UE y Am\u00e9rica Latina y el Caribe, c\u00f3mo los procesos de integraci\u00f3n subregionales han afrontado la transformaci\u00f3n digital en ALC, y las diferencias y semejanzas entre ambas regiones; analizando la importancia, la necesidad y los beneficios de lograr la Cooperaci\u00f3n Estrat\u00e9gica Digital entre la UE y ALC. Artificial Intelligence (AI), particularly generative AI, is considered revolutionary and disruptive technology and, as such, has the potential to rapidly replace other technologies. Its rapid installation in social reality represents a challenge to the regulatory capacity of economic blocs and States. While it expands human capabilities in knowledge production, task automation, and content creation on an unprecedented scale, its use raises macro-structural risks related to fundamental rights, democracy, the world of work, and the environment. This article analyzes the European Artificial Intelligence Regulation (EU AI Act 2024\/1689) and Brazilian Bill No. 2338\/2023 and aims to identify mechanisms for addressing the risks associated with AI and evaluate their sufficiency in protecting fundamental rights. Based on Ulrich Beck’s concept of a risk society, we examine the difference between predictive (specialized) AI and generative AI and then analyze the risks to fundamental rights posed by these technologies. A significant convergence was found between the European and Brazilian regulatory frameworks, both grounded in risk-based proportional regulation and the centrality of fundamental rights protection. However, relevant gaps were identified: in the European model, challenges persist in regulating general-purpose (GPAI) systems and in the practical implementation of supervisory mechanisms; and in the Brazilian model, the absence of a clearly defined competent authority, insufficient technical standards for explainability, and deficiencies in the proportionality of sanctions. We concluded that, although consistent at the normative level, the European and Brazilian regimes still require additional regulation, greater institutional capacity for implementation, and stronger practices by independent authorities to ensure the effectiveness and immediate justiciability of fundamental rights in the context of artificial intelligence and its risks.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

On August 1, 2024, Regulation (EU) 2024\/1689 of the European Parliament and of the Council entered into force, establishing harmonized rules on artificial intelligence, the so-called Artificial Intelligence Act (AI Act). Although its full application is scheduled for the coming years, the AI Act has already become a global regulatory milestone. Structured around a risk-based approach, the regulation seeks to ensure safety, transparency, and respect for fundamental rights. Through bibliographic and documentary review, this study analyzes the obligations imposed on high-risk AI systems under the AI Act, assessing whether the compliance and oversight mechanisms provided are sufficient to guarantee the protection of the fundamental rights of individuals potentially affected by their use. It is hypothesized that the effectiveness of these instruments remains uncertain regarding the assurance of fundamental rights protection, particularly due to the high technical complexity of artificial intelligence systems, the asymmetries between large corporations and small developers, and the rapid technological evolution, which continuously challenges the updating and adequacy of existing norms. Given the complexity and dynamism of the risks involved, it is concluded that the effectiveness of fundamental rights protection will depend on the adoption of complementary instruments and periodic reviews that ensure more agile and substantive regulatory responses, capable of preventing the AI Act from becoming obsolete in the face of constant technological transformations.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

El documento analiza los efectos adversos de la inteligencia artificial, particularmente en chatbots, enfoc\u00e1ndose en los riesgos de la desinformaci\u00f3n, la polarizaci\u00f3n y la discriminaci\u00f3n algor\u00edtmica. Se explora la evoluci\u00f3n de los chatbots, desde sistemas basados en reglas hasta modelos de lenguaje avanzados como A.L.I.C.E.\u00ae, Replika\u00ae, ChatGPT\u00ae, Bard\u00ae y DeepSeek\u00ae. Adem\u00e1s, se propone la Inteligencia Artificial Explicada (XAI) como una soluci\u00f3n para mitigar estos riesgos mediante la explicabilidad de los sistemas de IA. Finalmente, se eval\u00faa la aplicaci\u00f3n de los principios de XAI en diferentes chatbots, identificando sus fortalezas y debilidades en cuanto a explicabilidad, interpretabilidad, y \u00e9tica. El objetivo del art\u00edculo es analizar desde un enfoque universal y regional del sistema europeo, con una metodolog\u00eda deductiva la evoluci\u00f3n del reconocimiento del derecho a la privacidad, el derecho a la autodeterminaci\u00f3n informativa y la protecci\u00f3n de datos personales, as\u00ed como los esfuerzos transnacionales del Consejo de Europa para replicar esta visi\u00f3n como derechos fundamentales en otras latitudes, particularmente en el sistema interamericano, en contraposici\u00f3n con la visi\u00f3n estadounidense que los limita a los derechos de los consumidores. En esencia, se examinan las implicaciones de lo estipulado en el Convenio 108 del Consejo de Europa para la Protecci\u00f3n de las Personas con respecto al Tratamiento Automatizado de Datos de Car\u00e1cter Personal, un documento que ha procurado ampliar la coordinaci\u00f3n internacional como valor fundamental para hacer frente a los desaf\u00edos que suponen las violaciones de estos derechos humanos en el entorno digital. Sin dejar de considerar los di\u00e1logos jurisprudenciales y la forma en que el desarrollo normativo dentro del continente europeo ha sido recibido y reconocido por otros sistemas regionales, como lo es particularmente el interamericano. The article presents a critical and policy-oriented analysis the impact of intelligent automation on the intergenerational pact that underpins social security systems, emphasizing its potential to generate structural inequalities. It recognises that artificial intelligence systems contribute to the devaluation of living labour, the precarisation of employment, the obsolescence of professions and the concentration of wealth in the hands of private actors by relying on the appropriation of human skills and technical-scientific knowledge. Without adequate tax compensation mechanisms in place to replace human labour, intelligent automation undermines the contributory basis of pension systems and threatens intergenerational solidarity, particularly in contexts where companies exploit fiscal and regulatory loopholes. The article therefore argues for a rethink of the social security financing model, proposing the creation of specific fiscal instruments to redistribute the benefits of technological progress and ensure intergenerational justice. The main methodological approach adopted was legal-propositional, with a qualitative and theoretical-applied character. Resumen<\/h4>

El advenimiento de las criptomonedas ha inaugurado una era de innovaci\u00f3n financiera en todo el mundo, pero tambi\u00e9n ha tra\u00eddo consigo complejos desaf\u00edos. En Paraguay, con su vasta capacidad de generaci\u00f3n de energ\u00eda hidroel\u00e9ctrica, la criptominer\u00eda se presenta como una atractiva oportunidad econ\u00f3mica. Sin embargo, esta actividad despliega consecuencias que merecen un an\u00e1lisis cr\u00edtico desde el derecho ambiental y el desarrollo sostenible. Este art\u00edculo se adentra en la creciente problem\u00e1tica de la criptominer\u00eda en territorio paraguayo desde la perspectiva de la sustentabilidad y la justicia ambiental. El objetivo principal es examinar la dualidad de la criptominer\u00eda: la promesa de desarrollo versus la amenaza de una explotaci\u00f3n energ\u00e9tica desmedida y socioambientalmente predatoria. Como objetivos espec\u00edficos, se abordan: a) el impacto ambiental de la criptominer\u00eda como problema \u00e9tico-jur\u00eddico; b) las desigualdades territoriales y socioambientales implicadas; y c) el estudio del marco normativo actual del pa\u00eds (o su ausencia), que ha permitido la proliferaci\u00f3n de \"granjas\" mineras. La metodolog\u00eda aplicada es el m\u00e9todo inductivo, partiendo de la situaci\u00f3n espec\u00edfica para analizarla en el contexto general del campo jur\u00eddico, utilizando para ello el estudio bibliogr\u00e1fico y documental. Con un trabajo acumulado de aproximadamente 100 millones de procesos, en las \u00faltimas d\u00e9cadas el Poder Judicial brasile\u00f1o ha realizado un esfuerzo para digitalizar todo su acervo de procesos y ponerlo a disposici\u00f3n de los usuarios en plataformas en l\u00ednea. Como resultado, actualmente es posible trabajar de manera completamente digital, incluso con la adopci\u00f3n de soluciones de inteligencia artificial. La adopci\u00f3n de tales soluciones no est\u00e1 exenta de cr\u00edticas, pero el Consejo Nacional de Justicia ha regulado y supervisado su uso mediante la Resoluci\u00f3n 615, de 11 de marzo de 2025, que busca asegurar la transparencia, la publicidad y un uso \u00e9tico y centrado en el ser humano. This article presents the results of the Concil-IA Project, an interdisciplinary initiative developed at the Federal University of Santa Catarina (UFSC) in partnership with the institution\u2019s Small Claims Court, aimed at creating an Artificial Intelligence (AI)-based Online Dispute Resolution (ODR) platform for consumer conflicts. The research consolidated its contributions into three main areas: predictive modeling, explainability, and validation of the digital interface. In the field of predictive modeling, a regression model was developed using 1,851 anonymized judicial decisions related to air transport disputes. Several Machine Learning techniques (Decision Tree, Random Forest, and AdaBoost) were tested, and the Decision Tree Regressor was selected for balancing performance, interpretability, and computational efficiency. The model achieved satisfactory results, with a mean absolute error of approximately R$ 1,672 and a root mean squared error of R$ 2,286, confirming its suitability for real-world conciliation scenarios.\u00a0 Regarding explainability, Explainable Artificial Intelligence (XAI) methods were applied through SHAP (SHapley Additive exPlanations). This approach enabled both global interpretation of the model and local explanations for specific cases, highlighting as the most relevant factors in compensation predictions the flight delay or cancellation and the absence of assistance provided by the airline. Finally, the model was incorporated into a responsive web platform (concilia.ufsc.br \/ app.concilia.ufsc.br), developed in WordPress and validated with conciliators and court staff. Usability tests, carried out through structured questionnaires, showed high levels of acceptance, with average scores between 4.8 and 5.0 in clarity, organization, comfort, and perceived effectiveness. The findings confirm the technical feasibility and institutional relevance of Concil-IA as a digital innovation for conflict resolution, particularly judicial conciliation. In a scenario of technological advancements, electronic platforms, especially WhatsApp, have become highly relevant tools for communication and transactions, with 2.95 billion global users and a 98% adoption rate in Brazil, where 79% use it for commercial interactions. WhatsApp is classified as “Social Commerce” due to its integration of social interaction and commercial transaction, with features such as payment links and digital catalogs. This paper analyzes the validity of legal transactions conducted via WhatsApp, exploring the absence of physical signatures in conditional agreements. It therefore seeks to understand the validity of such agreements in light of the lack of specific legislation, proposing alternatives to strengthen legal certainty in digital transactions. The central hypothesis is that, despite their informality, these contracts are valid, but it highlights the urgent need for regulation and improvements to the app and to secure practices. The objective is to understand the validity of these agreements in the absence of specific legislation, proposing applicable alternatives for such transactions in order to strengthen legal certainty in digital transactions, following European models. Este trabajo analiza el R\u00e9gimen Global de Sanciones de Derechos Humanos de la Uni\u00f3n Europea (RGSDH), un instrumento dise\u00f1ado para responder a graves violaciones de derechos a nivel mundial. El objetivo principal es evaluar la efectividad del RGSDH en el contexto de Am\u00e9rica Latina, especialmente al compararlo con los mecanismos del Sistema Interamericano de Derechos Humanos (SIDH). Para ello, se emplea una metodolog\u00eda cualitativa respaldada por el an\u00e1lisis documental de normativa y fuentes oficiales, as\u00ed como la revisi\u00f3n de literatura acad\u00e9mica relevante y el estudio de casos espec\u00edficos. Los hallazgos principales indican que la efectividad del RGSDH es matizada. Si bien ofrece una v\u00eda para la rendici\u00f3n de cuentas, enfrenta desaf\u00edos significativos para su aplicaci\u00f3n efectiva en Am\u00e9rica Latina. Resumen<\/h4>

La Uni\u00f3n Europea rubric\u00f3 el Instrumento de Vecindad, Cooperaci\u00f3n al Desarrollo y Cooperaci\u00f3n Internacional, en el Reglamento 2021\/947, como una herramienta capacitada para incrementar el posicionamiento ecum\u00e9nico de la organizaci\u00f3n. Con dicha finalidad, se preve\u00eda la promoci\u00f3n de los valores europeos en terceros pa\u00edses, como aqu\u00e9llos que componen la regi\u00f3n de Am\u00e9rica Latina y el Caribe. En esta investigaci\u00f3n, y siguiendo las directrices marcadas por el citado Reglamento, se tiene por finalidad analizar el concepto de Estado de Derecho aplicable a las relaciones entre la Uni\u00f3n Europea y Am\u00e9rica Latina y el Caribe. Para ello, se atendr\u00e1, principalmente, a los tiempos convulsos vividos en ambas regiones, dado que han podido ser una causa de la disminuci\u00f3n del \u00edndice de Estado de Derecho que, seg\u00fan la percepci\u00f3n ciudadana, adolece a los Estados, y que se empiezan a recoger en los informes globales de asociaciones y entidades del tercer sector social. Asimismo, se estudiar\u00e1, en relaci\u00f3n con los Objetivos de Desarrollo Sostenible, como medidor universal del progreso en resiliencia sostenible de los Estados, el objetivo n\u00famero 16 sobre \u00abpaz, justicia e instituciones s\u00f3lidas\u00bb, vi\u00e9ndose la aplicaci\u00f3n de este en su interconexi\u00f3n con el Instrumento en la regi\u00f3n latinoamericana y caribe\u00f1a. Para finalizar este trabajo, se analizar\u00e1 la globalizaci\u00f3n existente y c\u00f3mo esta afecta a las relaciones entre ambas regiones y si se est\u00e1 produciendo una extensi\u00f3n y proliferaci\u00f3n de sus conceptos de democracia y Estado de Derecho, o si por el contrario, se est\u00e1n optando por otras influencias, como puede ser la asi\u00e1tica de la mano de China. Esto nos permitir\u00e1 alcanzar unas conclusiones con relaci\u00f3n a la idoneidad del Instrumento para la promoci\u00f3n del concepto de democracia y Estado de Derecho de la Uni\u00f3n Europea como forma de su cooperaci\u00f3n internacional al desarrollo con regionalizaci\u00f3n en Am\u00e9rica Latina y la posibilidad de utilizar el Estado de Derecho como elemento de uni\u00f3n entre ambas regiones.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
