Carbon border measures\u2014particularly emissions-based border adjustment regimes\u2014operate in practice as hybrid instruments: while justified as climate policy, they impose compliance duties, assessments, monetary liabilities, penalties, and review processes that resemble those of tax and customs administration. This hybrid design poses governance and legitimacy challenges for \u201cfair and free trade\u201d agendas: if procedures are opaque, discretionary, or excessively burdensome, carbon border measures may exclude smaller exporters, deepen North\u2013South asymmetries, and increase the likelihood of disputes in trade and investment fora. This article develops a conceptual fair-treatment framework for carbon border measures, focusing on procedural fairness and dispute prevention for exporters, with particular attention to EU\u2013Latin America trade relations. The article makes three contributions. First, it maps the exporter\u2019s procedural journey and identifies recurring friction points (scope and classification, emissions methodology, verification, correction windows, assessments, penalties, and review). Second, it proposes a Fair Treatment Procedural Matrix that sets minimum safeguards at each stage: notice and guidance, access to evidence, an opportunity to respond and cure, reasoned decision-making, proportional enforcement, and effective appeal. Third, it offers a dispute-prevention toolkit grounded in transparency, cooperative compliance, mutual recognition of verification, phased implementation, and proportionality-based cost mitigation. En este art\u00edculo expondremos c\u00f3mo se han ido articulando los discursos y las pr\u00e1cticas econ\u00f3micas del comercio en torno a los principios \u00e9ticos de la libertad y la justicia. Sostendremos que desde el pensamiento cl\u00e1sica aristot\u00e9lico hasta el Renacimiento, con especial importancia de lo ocurrido en la Edad Media, hubo un fuerte inter\u00e9s en regular \u00e9ticamente las reglas del comercio en torno a normas sociales y religiosas. A partir del Renacimiento y sobre todo con el advenimiento de la Modernidad, las libertades y m\u00e1s concretamente el valor de la libertad econ\u00f3mica comienza a ser de fundamental importancia para avanzar hacia una econom\u00eda menos regulada, confiada en el actuar de la \u201cmano invisible\u201d (sistema de mercado). Analizado el contexto del desarrollo de la historia de las ideas, nos proponemos en segundo t\u00e9rmino responder a la pregunta de si acaso el comercio debe ser entonces justo o libre. Mientras algunas corrientes actuales del pensamiento econ\u00f3mico insisten en las virtudes de la autoregulaci\u00f3n de los mercados, otros movimientos justamente preocupados por las consecuencias de un orden internacional de libre mercado han levantado las banderas por un comercio justo. En el marco de ese debate, este autor propone que, para sociedades sustentables, ser\u00e1 necesario un comercio todo lo libre que sea posible, pero siempre orientado por criterios de justicia social y ambiental. El presente articulo busca analizar en una primera parte las distintos etapas y la evoluci\u00f3n del comercio mundial. Para luego relacionar este desarrollo con el crecimiento y conformaci\u00f3n de una nueva sociedad internacional donde se destaca el progreso logrado por algunas naciones con China que reorganizaron su participaci\u00f3n en el mundo econ\u00f3mico a partir de su creciente comercio, siendo hoy una potencia mundial .Pero el presente articulo tambi\u00e9n busca destacar la conjunci\u00f3n de dos variables interesantes que conforman hoy un binomio del nuevo progreso y desarrollo econ\u00f3mico Ellas son el comercio libre y el comercio justo cuya conjunci\u00f3n contribuye de manera significativa a la construcci\u00f3n de econom\u00edas inclusivas, en las que el crecimiento econ\u00f3mico puede ir de la mano de la justicia social, la sostenibilidad ambiental y la reducci\u00f3n de desigualdades. This article seeks to offer a critical reflection on the intrinsic, and historically controversial, relationship between international trade and labour and, in particular, on how this relationship has been shaped through the conclusion of preferential trade agreements, notably by the European Union, with the aim of introducing the idea of justice or fair trade into the architecture of the free trade system. Contrary to what is seen in the GATT\/WTO multilateral trading system, where there are no standards concerning labour rights, preferential trade agreements have proliferated with chapters dedicated to enshrining labour standards, whose configurations, but also possibilities and limitations, must continue to be discussed. The so-called \u201cpromotional\u201d model of labour standards adopted by the European Union since the trade agreement concluded with the Republic of Korea in 2010, which includes a single chapter dedicated to \u201ctrade and sustainable development\u201d, is the example from which we propose to analyze the scope of these standards and the prospects that may be opened up for the international protection of workers’ rights. The Precautionary Principle (PP), codified in Article 191(2) of the Treaty on the Functioning of the European Union (TFEU), has evolved from an environmental guideline into a general principle of EU law. In recent years, the EU has incorporated the PP into the Trade and Sustainable Development (TSD) chapters of Free Trade Agreements (FTAs), reinforcing the parties\u2019 \u201cright to regulate\u201d in matters of environmental and health protection, even amidst scientific uncertainty, when a risk is identified. However, EU\u2019s comparatively low risk threshold may generate legal tensions with trade partners. This research examines the legitimacy of the EU\u2019s application of the PP in FTAs, focusing on the EU-Mercosur Association Agreement. It asks whether precautionary measures promote inclusive cooperation or operate as disguised non-tariff barriers that disadvantage emerging economies. To address this question, the study adopts an empirical-analytical methodology using a jurimetrics approach. Through Python-based data analysis, it evaluates Court of Justice of the European Union (CJEU) judgments between 2000 and 2023, drawn from the IUROPA CJEU Database, to quantify the internal judicial rigour applied to the PP. This statistical analysis contrasts the EU\u2019s relatively restrained domestic judicial practice with its broader external standard-setting in FTAs. The research also considers relevant decisions of the World Trade Organization\u2019s Dispute Settlement Bodies to assess the perception of unilateralism in the use of the PP. The findings show that inclusive economic cooperation depends on narrowing the gap between the CJEU\u2019s internal scrutiny and the EU\u2019s external enforcement of precautionary standards. Resumen<\/h4>

The present study adopts a legal-dogmatic method with an interdisciplinary approach, articulating categories of Public International Law with elements of international political economy. The analysis is developed through a critical review of specialized scholarship and a structural examination of the provisions of the Mercosur\u2013European Union Agreement, with particular attention to the productive and institutional asymmetries that characterize center\u2013periphery relations in global trade. This is analytical and critical-structural research, whose objective is not merely to describe the normative content of the agreement, but to assess its potential distributive and institutional effects. It proceeds from the understanding that trade liberalization, although potentially conducive to economic growth, does not by itself guarantee equitable development or distributive justice. As illustrated by the composition of trade flows between the blocs examined in this study, European exports are predominantly composed of high value-added industrial goods, whereas Mercosur exports largely consist of primary products, in light of the structuralist theory of ECLAC and Dependency Theory. The study also examines European regulatory extraterritoriality, particularly regarding the imposition of environmental and sanitary standards as conditions for access to the European Union market, questioning its legitimacy on the basis of \u201cimpure\u201d extraterritoriality as recognized within International Law. Finally, the impacts of the agreement on vulnerable communities are assessed, and pathways are proposed to promote fairer and more sustainable trade. It is also concluded that, as a development instrument, the agreement will only be effective if it incorporates binding mechanisms for socio-environmental protection, technical cooperation, and value-added policies capable of mitigating historical structural inequalities.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

This study aims to analyze the legal framework of Geographical Indications (GIs) within the Partnership Agreement (EMPA) and the Interim Trade Agreement (ITA) between the European Union and Mercosur, focusing on institutional asymmetries between the blocs and the challenges of their territorial implementation. The methodology adopted is qualitative and exploratory in nature, based on bibliographic research for data collection from legislation, scientific articles, and official documents. As a synthesis of the final considerations, a structural gap is identified between the legal recognition of GIs and their actual capacity to produce economic transformation in Global South territories. This article analyzes the protection of cultural heritage in the context of international art trade, focusing on the tension between free movement and cultural sovereignty within the framework of the European Union\u2013Mercosur Agreement. Adopting a legal-dogmatic and comparative methodology, it examines the main applicable international instruments, the European Union regime on the export, import, and restitution of cultural goods, and the Brazilian model of constitutional and infraconstitutional protection of cultural heritage. The central hypothesis is that the EU\u2013Mercosur Agreement does not impose full harmonization of the regimes applicable to cultural goods, but may operate as a platform for minimum regulatory approximation, based on criteria of transparency, licensing, proof of provenance, and administrative cooperation. This study investigates the relationship between the peasant movement and fair trade in Latin America, focusing on experiences developed in Honduras and their convergence with European Union sustainability policies. Grounded in Gramscian theory of hegemony, the research examines how counter-hegemonic commercial practices strengthen the economic and political autonomy of the peasantry, challenging structural inequalities imposed by global capitalism. The research problem explores how fair trade acts as a strategy of resistance and how this model meets the criteria for economic justice and fair remuneration valued in trade relations between the EU and Latin America. The hypothesis suggests that fair trade, by offering equitable conditions and fair prices, enhances the empowerment of rural producers and serves as a compliance mechanism with new due diligence and governance standards required by the European market. The methodology consists of a qualitative and exploratory approach, using bibliographic and documentary analysis to articulate the local resistance of leaders such as Elvia Alvarado with the normative frameworks of bi-regional cooperation. It is concluded that fair trade represents a viable alternative that subverts the logic of exploitation and promotes the sovereign integration of the Honduran peasantry into global value chains, aligning with the principles of solidarity and sustainable development advocated by the Jean Monnet network.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Este art\u00edculo analiza el modelo agroexportador del oriente boliviano desde la perspectiva del extractivismo agr\u00edcola y eval\u00faa su compatibilidad con los est\u00e1ndares contempor\u00e1neos de comercio responsable y sostenibilidad ambiental promovidos por la Uni\u00f3n Europea. A partir del caso del sector soyero en Santa Cruz, se examina c\u00f3mo la expansi\u00f3n de la frontera agr\u00edcola, basada en el uso intensivo del capital natural y en una l\u00f3gica de acumulaci\u00f3n orientada a la exportaci\u00f3n, ha profundizado la crisis clim\u00e1tica regional mediante la deforestaci\u00f3n masiva y el uso intensivo de agroqu\u00edmicos, configurando un patr\u00f3n de crecimiento incompatible con los principios del comercio justo y sostenible. El estudio integra la teor\u00eda del extractivismo agr\u00edcola, enmarcado en el comercio justo, las cadenas globales de valor y la gobernanza de est\u00e1ndares privados, para evaluar de esta manera la brecha entre el modelo productivo boliviano y las exigencias del European Green Deal (2019), el Reglamento Europeo contra la Deforestaci\u00f3n y la Directiva de Debida Diligencia Corporativa. Resumen<\/h4>

En Am\u00e9rica latina, s\u00f3lo Bolivia y Ecuador han logrado constitucionalizar los principios y objetivos de la transici\u00f3n verde, vinculados con el reconocimiento de los derechos de la Madre Tierra, rompiendo la estructura geneal\u00f3gica del sistema jur\u00eddico romanista y estableciendo una relaci\u00f3n directamente proporcional con los derechos de los pueblos originarios. Se ha logrado construir un constitucionalismo sostenible y una jurisprudencia acorde al reconocimiento de los derechos de la Madre Tierra, en el entorno del \u201cVivir Bien\u201d, que precisamente atribuyen al Estado competencias de promoci\u00f3n, protecci\u00f3n y defensa de los derechos reconocidos a la tierra y la biodiversidad, que en la pr\u00e1ctica se topan con intereses corporativos que superponen sus derechos y logran establecer mecanismos de dispersi\u00f3n que dilatan la ejecuci\u00f3n de los derechos al l\u00edmite de vulnerarlos, en perjuicio de las futuras generaciones, discerniendo entre la pertinencia de las decisiones de las autoridades judiciales y la din\u00e1mica del desarrollo.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Resumen<\/h4>

La irrupci\u00f3n de la inteligencia artificial (IA) como fuerza estructurante de la econom\u00eda global plantea desaf\u00edos de particular urgencia para Am\u00e9rica Latina y el Caribe. Este art\u00edculo analiza la posici\u00f3n de la regi\u00f3n frente a esta transformaci\u00f3n tecnol\u00f3gica desde tres dimensiones complementarias. En primer lugar, examina el impacto econ\u00f3mico global de la IA y la tendencia a profundizar las asimetr\u00edas existentes entre econom\u00edas avanzadas y econom\u00edas en desarrollo. En segundo lugar, a partir de los hallazgos del \u00cdndice Latinoamericano de Inteligencia Artificial (ILIA) 2025, elaborado conjuntamente por la CEPAL y el Centro Nacional de Inteligencia Artificial de Chile, se analiza el estado de preparaci\u00f3n de 19 pa\u00edses de la regi\u00f3n en materia de infraestructura, talento, investigaci\u00f3n y gobernanza. En tercer lugar, se examina la paradoja de los recursos: Am\u00e9rica Latina concentra reservas estrat\u00e9gicas de tierras raras y litio \u2014minerales cr\u00edticos para la fabricaci\u00f3n del hardware que sostiene la IA\u2014 pero permanece relegada al rol de proveedora de materias primas, sin capturar el valor agregado de su procesamiento. El art\u00edculo argumenta que esta triple condici\u00f3n \u2014consumidora de tecnolog\u00eda que no desarrolla, exportadora de minerales que no procesa, y ausente de los foros donde se define la gobernanza global de la IA\u2014 configura una nueva forma de dependencia estructural. Frente a ello, se propone una agenda de equidad digital articulada en torno a tres ejes: inversi\u00f3n en infraestructura de c\u00f3mputo soberana, industrializaci\u00f3n mineral con valor agregado, y gobernanza \u00e9tica de la IA con referencia al marco regulatorio europeo. This study examines human trafficking in Europe through the activities of organized crime networks and the use of social media platforms, highlighting key concepts, statistical trends, and comparative case studies between Belgium and Germany. It aims to analyze the relationship between digital platforms and criminal networks in facilitating human trafficking and to assess the effectiveness of the European Union’s dual approach, which combines a legislative framework with practical measures. The methodology includes legal analysis, the use of Eurostat 2024 data, and comparative case studies, focusing on methods of exploitation, victim characteristics, and the use of digital technologies. The results indicate a strong link between digital platforms and criminal networks, with various forms of exploitation including sexual exploitation, forced labor, and child exploitation. Resumen<\/h4>

El presente art\u00edculo pretende ofrecer un estado de la cuesti\u00f3n sobre la interacci\u00f3n entre los procesos de restituci\u00f3n de menores il\u00edcitamente trasladados o retenidos que, al mismo tiempo, son solicitantes de protecci\u00f3n internacional en el Estado de la sustracci\u00f3n. Ante la falta de una regla espec\u00edfica de coordinaci\u00f3n en los principales instrumentos internacionales, se ha realizado un estudio sistem\u00e1tico de la jurisprudencia y doctrina relevantes que han tratado la materia a nivel europeo y americano, en casos donde ambas solicitudes de restituci\u00f3n y asilo discurr\u00edan en paralelo. Del an\u00e1lisis realizado, se concluye que la existencia de una solicitud de protecci\u00f3n internacional puede afectar a la calificaci\u00f3n como il\u00edcito del traslado de un menor, as\u00ed como a la apreciaci\u00f3n de la existencia de causas de denegaci\u00f3n de la restituci\u00f3n. Asimismo, genera controversias en cuanto a la necesidad de suspender el procedimiento de restituci\u00f3n a la espera de una decisi\u00f3n sobre el asilo, para evitar el riesgo de resoluciones contradictorias. Ello refuerza la necesidad de que a nivel institucional se desarrollen normas o gu\u00edas de actuaci\u00f3n concretas.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
