Resumen<\/h4>

The paper seeks to explain the instruments that the European Union has to ensure that fundamental European values, including the idea of \u201crule of law\u201d, are respected by Member States. Resumen<\/h4>

Las pugnas territoriales en Colombia han estado en el n\u00facleo mismo del conflicto armado, lo cual ha hecho de este el pa\u00eds con mayor desplazamiento en el mundo. A ra\u00edz de sus m\u00faltiples afectaciones, como producto de los Acuerdos de Paz el gobierno nacional de ese entonces cre\u00f3 la Ley de V\u00edctimas y Restituci\u00f3n de Tierras (1448 de 2011). No obstante, la delimitaci\u00f3n temporal de la misma excluye a una gran cantidad de v\u00edctimas de perdieron sus predios antes del 1ero. de enero de 1991, durante la d\u00e9cada de los 80 cuando se profundiz\u00f3 el conflicto en el pa\u00eds. En este sentido, el presente art\u00edculo busca indagar sobre los alcances y desaf\u00edos de la implementaci\u00f3n de esta Ley en la Zona Bananera, municipio ampliamente afectado por din\u00e1micas de explotaci\u00f3n de recursos naturales, narcotr\u00e1fico y paramilitarismo, que, por lo dem\u00e1s, cuenta con una poblaci\u00f3n mayoritariamente afrocolombiana, aspecto que supone la aplicaci\u00f3n de un enfoque diferencial.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

In recent years, the Constitutional Court of Romania has tried to create an internal wall for not giving effect to the application of the supremacy of European Union law, respectively the judgments of the Court of Justice of the European Union regarding the rule of law, as regards the Constitution itself, by developing an ultra vires<\/em> control and an identity control in an original way. Although the pressure to change such an approach is omnipresent, however, the reasons of Decision no. 390\/2021 have not been revised until today by the subsequent case law of the Constitutional Court of Romania, but on the contrary, in two press releases, the idea of revising the Constitution for accepting the effects of the relevant case law of the Court of Justice of the European Union in the matter was launched exclusively. However, a series of somehow sovereignist decisions, also including here the interpretation in its own, extensive manner, of an opinion of the Venice Commission, seems rather on the way to be abandoned, an example in this regard being the recent Decision no. 283\/2023, by which the Constitutional Court of Romania restated the need to impose a threshold in the case of the offence of abuse of office.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Resumen<\/h4>

El presente estudio se focaliza en la funci\u00f3n del Tribunal Permanente de Revisi\u00f3n \u201cTPR\u201d como posible actor para el afianzamiento de la gobernabilidad democr\u00e1tica y el estado de derecho. En este sentido, la pregunta que ser\u00e1 eje de an\u00e1lisis de este trabajo est\u00e1 planteada en los siguientes t\u00e9rminos: \u00bfPosee el TPR alguna funci\u00f3n tendiente a garantizar la gobernabilidad democr\u00e1tica y el estado de Derecho en los Estados que conforman este proceso de integraci\u00f3n? Como se puede observar, este estudio parte de una visi\u00f3n sist\u00e9mica donde el Tribunal supremo del Mercosur podr\u00eda estar en relaci\u00f3n de retroalimentaci\u00f3n con los sistemas jur\u00eddicos internos de los Estados partes que lo conforman. El Trabajo se encuentra organizado de la siguiente forma: (i) en primer lugar, se efect\u00faan algunos lineamientos sobre las nociones centrales utilizadas en este trabajo (gobernabilidad democr\u00e1tica, estado de derecho y rule of law) (ii) en segundo t\u00e9rmino, haremos una exposici\u00f3n general sobre los elementos esenciales que componen la llamada dimensi\u00f3n democr\u00e1tica amplia y el Protocolo de Ushuaia (PU) sobre compromiso democr\u00e1tico en el MERCOSUR, (iii) Seguidamente abordaremos la cuesti\u00f3n del rol de la jurisdicci\u00f3n en los procesos de integraci\u00f3n en general y del MERCOSUR, en particular, focalizando la atenci\u00f3n en la labor que posee el TPR, (iv) finalmente, ser\u00e1 tra\u00eddo a consideraci\u00f3n un Laudo emitido por el TPR que puede dejar algunos indicios para responder a la pregunta planteada. With the enactment of the 1988 Brazilian Federal Constitution, the Brazilian constitutional system witnessed a great expansion of the powers of the Judiciary, along with a considerable growth of the influence of the Supremo Tribunal Federal (STF) in the everyday life. Not only were such changes brought by crucial reforms, but also by the change of the social-political context. Such a context, characterized by the desire of re-democratization of the Country, led to a gradual opening of the Tribunal to the society. So far, one of the major connection tools between the Court and the public opinion has been the peculiar decision-making process of the STF. If on the one hand such process seems to have favoured transparency and participation of the society to the life of the Tribunal, on the other hand it has created not few concerns, namely with regard the high individualism and the extreme publicity that both govern the decision-making process. Indeed, the objective of the present work is to inquire the extent to which these issues affect the current decisional process of the Supremo, also with the aim to find how further negative consequences might be overcame. The research adopts an in-depth qualitative analysis of the relevant doctrine on the issues, with a small comparative glimpse on other constitutional experiences. The paper suggests the urgent need to reform the current mechanism of deliberation of the Supremo Tribunal Federal, with the aim of reducing the abovementioned disproportionate individualism and excessive transparency.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Resumen<\/h4>

This descriptive article aims to analyze the effects of restricting the right to vote for people deprived of their liberty, already socially excluded and stigmatized due to their condition, in denying the individual’s exercise of citizenship, resulting in an increase in crime. In the first chapter, through the hypothetical-deductive methodology, based on a systematic bibliographical review of primary and secondary sources, the paper gathers and analyzes the literature and existing legislation about political rights of prisoners in the Brazilian context and their restriction hypotheses. In the following topic, in addition to the aforementioned methodology, data were presented on the scenario of the Brazilian prison system, using quantitative empirical research, with secondary sources, to elucidate the scenario of mass incarceration and outline hypotheses, as well as statements about the logic of the punitive system and the growth of criminal factions. Finally, in the last chapter, through the hypothetical-deductive methodology of bibliographic review, the need for state action was highlighted, using public policies, to comply with the dictates contained in the 1988 Federal Constitution, expanding the citizenship of prisoners through voting, promoting social inclusion.<\/p><\/section><\/div><\/div><\/section><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Resumen<\/h4>

El objetivo del presente trabajo es analizar el principio de la soberan\u00eda de los Estados sobre los recursos naturales (PSRN)desde el enfoque del Derecho Internacional de los Derechos Humanos. La Declaraci\u00f3n de las Naciones Unidas y la Declaraci\u00f3n Americana sobre los Derechos de los pueblos Ind\u00edgenas que reconocen su derecho a la libre determinaci\u00f3n y el derecho a la propiedad colectiva nos plantean la hip\u00f3tesis sobre la extensi\u00f3n del PSRN hacia el reconocimiento de los derechos de los pueblos ind\u00edgenas para ejercer jurisdicci\u00f3n sobre sus tierras y territorios ancestrales. Se ha realizado un estudio documental del origen y desarrollo del PSRN en relaci\u00f3n con el derecho de la libre determinaci\u00f3n de los pueblos y se concluye que en un contexto no colonial los pueblos ind\u00edgenas son titulares de ese derecho y que el derecho a sus territorios, a la tierra y a los recursos naturales son elementos del PSRN, el cual es la base de su autonom\u00eda pol\u00edtica y econ\u00f3mica. Este documento examina el modelo de participaci\u00f3n de la pol\u00edtica europea de vecindad en proyectos del Espacio Europeo de Investigaci\u00f3n. De este modo, el estudio aporta informaci\u00f3n sobre el papel que desempe\u00f1a el Espacio Europeo de Investigaci\u00f3n en la consecuci\u00f3n de los objetivos y ambiciones de la UE en el contexto de la pol\u00edtica europea de vecindad. La pregunta de investigaci\u00f3n que impulsa este estudio es \u00bfQu\u00e9 patr\u00f3n de arquetipos de proyectos denota la participaci\u00f3n de la vecindad meridional de la Uni\u00f3n en el espacio paneuropeo destinado a facilitar la libre circulaci\u00f3n de talento e ideas? La hip\u00f3tesis gu\u00eda anticipa que el arquetipo predominante corresponde a un encuentro que dura un proyecto, y que el compromiso prolongado a lo largo de varios proyectos consecutivos es una rareza. Esta indagaci\u00f3n sobre la relacionalidad tejida por la colaboraci\u00f3n en la investigaci\u00f3n formula cuatro arquetipos. El principal material emp\u00edrico empleado para modelar y estudiar los cuatro arquetipos son entrevistas semiestructuradas con directores de proyectos radicados en Europa. Las percepciones ofrecidas por los protagonistas de los proyectos financiados por el S\u00e9ptimo Programa Marco y Horizonte 2020 revelan c\u00f3mo los v\u00ednculos multilaterales impulsados por la investigaci\u00f3n contribuyen a las aspiraciones de acci\u00f3n exterior postwestfalianas. Las narrativas anal\u00edticas elaboradas demuestra las actuaciones de la diplomacia cient\u00edfica de la UE, por ejemplo, en forma de regalos tecnocient\u00edficos, as\u00ed como compartiendo y desarrollando conjuntamente \u2018kn\/own\/ables\u2019 (conocimientos\/propiedades\/habilidades). Las experiencias de los expertos en el desarrollo conjunto de soluciones de investigaci\u00f3n intensiva con colegas de Marruecos y T\u00fanez para abordar los retos m\u00e1s acuciantes a los que se enfrentan la UE y sus vecinos meridionales son muy \u00fatiles. Ofrecen nuevas perspectivas sobre las rutinas pautadas que sustentan la aplicaci\u00f3n de marcos de gobernanza supranacionales como el Espacio Europeo de Investigaci\u00f3n, incluidas sus dimensiones de acci\u00f3n exterior y diplomacia cient\u00edfica. Casi la mitad de los proyectos estudiados corresponden al arquetipo con una interacci\u00f3n de proyectos financiados por la UE. Esto confirma los v\u00ednculos relacionales m\u00e1s bien espor\u00e1dicos o ad hoc de la vecindad meridional de la Uni\u00f3n con el Espacio Europeo de Investigaci\u00f3n, facilitados por diversos centros de competencia con sede en Europa.<\/p>

El pasado 21 de mayo de 2024, el Tribunal Internacional del Derecho del Mar emiti\u00f3 su opini\u00f3n consultiva en el contexto de las cuestiones sometidas a opini\u00f3n por la Comisi\u00f3n de los Peque\u00f1os Estados Insulares sobre el cambio clim\u00e1tico y derecho internacional; dicho dictamen se constituye en referente fundacional para el derecho internacional respecto de las obligaciones de los Estados en materia ambiental y la lucha contra el Cambio Clim\u00e1tico en los mares y oc\u00e9anos.
